8 Section 4-120), which relates to cancellation of
9 voter registrations; requiring cancellation of voter
9 registration under certain circumstance; directing
10 the Secretary of the State Election Board to conduct
10 voter registration list comparison with certain
11 entities; requiring provision of notice of
11 noncitizenship to certain voter; requiring furnishing
12 of proof of citizenship to certain county election
12 board; requiring record of certain appearance in form
13 and manner prescribed by the Secretary; providing for
13 cancellation of voter registration under certain
14 circumstance; requiring reporting of certain
14 noncitizens; amending 26 O.S. 2021, Section 7-103.2,
15 as last amended by Section 2, Chapter 264, O.S.L.
15 2023 (26 O.S. Supp. 2024, Section 7-103.2), which
16 relates to voter registration list; specifying
16 qualifications for access to certain list; requiring
17 application for certain access; prohibiting access to
17 voter registration list for certain purpose;
18 prohibiting transmission of list to certain foreign
18 entities; providing for codification; and providing
19 an effective date.

22 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

1 SECTION 1. AMENDATORY 26 O.S. 2021, Section 4-120, as
1
2 last amended by Section 2, Chapter 357, O.S.L. 2023 (26 O.S. Supp.
2
3 2024, Section 4-120), is amended to read as follows:
3
4 Section 4-120. A. The registration of any registered voter
4
5 shall be canceled only for one of the following reasons:
5
6 1. Written notice from the voter pursuant to Section 4-120.1 of
6
7 this title;
7
8 2. Death;
8
9 3. Conviction of a felony;
9
10 4. Judicial determination of mental incapacitation under Title
10
11 30 of the Oklahoma Statutes;
11
12 5. Registration in another county or state;
12
13 6. Failure to respond to a confirmation of address mailing and
13
14 failure to vote as prescribed in Section 4-120.2 of this title;
14
15 7. The surrendering of the voter's Oklahoma driver license to
15
16 Service Oklahoma upon being issued a driver license in another
16
17 state; or
17
18 8. Being excused from jury duty for not being a citizen of the
18
19 United States; or
19
20 9. Determination that the voter is not a citizen of the United
20
21 States.
21
22 B. For purposes of this section, paragraphs 5 and 7 of
22
23 subsection A of this section shall constitute confirmation from the

1 voter to cancel his or her voter registration due to a change of
1
2 residence.
2
3 C. A list of voter registrations that were canceled during the
3
4 previous twenty-four (24) months, and the reason for the
4
5 cancellation, shall be made available to the public.
5
6 SECTION 2. NEW LAW A new section of law to be codified
6
7 in the Oklahoma Statutes as Section 4-122 of Title 26, unless there
7
8 is created a duplication in numbering, reads as follows:
8
9 A. The Secretary of the State Election Board shall compare the
9
10 list of registered voters in this state with the database of any
10
11 federal, state, or local agency, board, or commission that maintains
11
12 information regarding the citizenship of persons residing in this
12
13 state.
13
14 B. If a registered voter definitively matches a person who is
14
15 recorded in another database as not being a citizen of the United
15
16 States, the Secretary shall send a notice of such finding to that
16
17 voter. The voter shall, within thirty (30) days of receiving such
17
18 notice, appear at the office of the county election board where the
18
19 voter is registered and present proof of citizenship. Such proof
19
20 shall be the same requirements for proof of citizenship when
20
21 obtaining a Real ID pursuant to the provisions of the REAL ID Act of
21
22 2005, Public Law No. 109-13. The secretary of the county election
22
23 board shall make a record of the voter's appearance and note the
23

1 type of proof of citizenship that was presented on a form approved
1
2 by the Secretary of the State Election Board.

3 C. If a voter fails to present proof of citizenship within the
3
4 prescribed time or otherwise provides notice that the voter is not a
4
5 citizen, then the voter's registration shall be cancelled, and the
5
6 voter shall be reported to the appropriate district attorney and
6
7 United States attorney.

8 SECTION 3. AMENDATORY 26 O.S. 2021, Section 7-103.2, as
8
9 last amended by Section 2, Chapter 264, O.S.L. 2023 (26 O.S. Supp.
9
10 2024, Section 7-103.2), is amended to read as follows:
10
11 Section 7-103.2. A. 1. County election boards shall maintain
11
12 a current list of all registered voters in each precinct, which will
12
13 reflect the address and party affiliation of each voter. The list
13
14 shall be public information.
14
15 2. The list shall only be shared with a court system if that
15
16 court system agrees to regularly provide the names of persons
16
17 convicted of a felony in that court system to the Secretary of the
17
18 State Election Board and the appropriate secretary of a county
18
19 election board, or if the court system is required by state law to
19
20 provide such information.
20
21 3. The list shall note any voter for whom a first-class mailing
21
22 from the county election board or the State Election Board was
22
23 returned undeliverable.

1 B. 1. The Secretary of the State Election Board shall ensure
1
2 that an electronic copy of the voter registration list described in
2
3 subsection A of this section is made available, to the public free
3
4 of charge., to the following:
4
5 a. bona fide residents of this state who are citizens of
5
6 the United States,
6
7 b. official representatives of political parties
7
8 recognized by the laws of this state,
8
9 c. candidates for office in this state and their official
9
10 representatives, or
10
11 d. other persons authorized by state law.
11
12 2. Any person accessing the voter registration list shall be
12
13 required to complete an application form approved by the Secretary
13
14 which shall include:
14
15 a. the legal name, address of residence in this state,
15
16 telephone number, and electronic mail address of the
16
17 person,
17
18 b. an attestation under penalty of perjury that the
18
19 person is meets the legal requirements to access the
19
20 list, and
20
21 c. any additional information deemed necessary by the
21
22 Secretary.

23 3. It shall be unlawful for any person to use the voter
23
24 registration list for commercial purposes. Provided, for the

1 purposes of this section, a commercial purpose shall not include the
1
2 use of the voter list by campaigns, political parties, government
2
3 officials, or public opinion pollsters to contact or interact with
3
4 voters.
4
5 4. It shall be unlawful for any person to knowingly provide the
5
6 voter registration list to a foreign national, commercial interest,
6
7 or government entity.
7
8 SECTION 4. This act shall become effective November 1, 2025.
