8 An Act relating to agriculture; amending 2 O.S. 2021,
8 Section 5-107, which relates to the Oklahoma Meat
9 Consumer Protection Act; defining term; prohibiting
9 production of certain product; providing penalties;
10 providing for promulgation of rules; updating
10 statutory reference; providing for codification; and
11 providing an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16 SECTION 1. AMENDATORY 2 O.S. 2021, Section 5-107, is
16
17 amended to read as follows:
17
18 Section 5-107. A. There is hereby created the "Oklahoma Meat
18
19 Consumer Protection Act".
19
20 B. As used in the Oklahoma Meat Consumer Protection Act:
20
21 1. "Cell-cultured meat", also referred to as lab-grown meat,
21
22 cultivated meat, clean meat, in vitro meat, imitation meat,
22
23 synthetic meat, and fake meat, means a food product developed from
23
24 animal cell cultures rather than through traditional raising and

1 slaughtering of livestock. Cell-cultured meat does not include
1
2 imitation meat made of non-meat ingredients including, but not
2
3 limited to, plant-based protein;
3
4 2. "Livestock" means animals defined by paragraph 9 of Section
4
5 1-3 of Title 2 of the Oklahoma Statutes this title;
5
6 2. 3. "Meat" means any edible portion of livestock or part
6
7 thereof;
7
8 3. 4. "Misrepresent" means the use of any untrue, misleading,
8
9 or deceptive oral or written statement, advertisement, label,
9
10 display, picture, illustration, or sample; and
10
11 4. 5. "Represent" means the use of any form of oral or written
11
12 statement, advertisement, label, display, picture, illustration, or
12
13 sample.

14 C. Pursuant to the Oklahoma Meat Consumer Protection Act, no
14
15 person advertising, offering for sale, or selling meat shall engage
15
16 in any misleading or deceptive practices, including, but not limited
16
17 to, the following:
17
18 1. Misrepresenting the cut, grade, brand, trade name, or weight
18
19 or measure of any meat, or misrepresenting a product as meat that is
19
20 not derived from harvested production livestock; provided, product
20
21 packaging for plant-based items shall not be considered in violation
21
22 of the provisions of this paragraph so long as the packaging
22
23 displays that the product is derived from plant-based sources in
23

1 type that is uniform in size and prominence to the name of the
1
2 product;

3 2. Using a USDA-quality grade on a product not graded by the
3
4 United States Department of Agriculture (USDA) or Oklahoma
4
5 Department of Agriculture, Food, and Forestry (ODAFF); or
5
6 3. Failing to fully and conspicuously disclose the correct
6
7 government grade for any product if the product is represented as
7
8 having been graded by the USDA or ODAFF.

9 D. No person, firm, association, corporation, or any other
9
10 entity of this state shall manufacture or sell cell-cultured meat.
10
11 SECTION 2. NEW LAW A new section of law to be codified
11
12 in the Oklahoma Statutes as Section 5-107.1 of Title 2, unless there
12
13 is created a duplication in numbering, reads as follows:
13
14 A. Any person who knowingly violates subsection D of Section 5-
14
15 107 of Title 2 of the Oklahoma Statutes shall be guilty of a
15
16 misdemeanor.
16
17 B. Any food establishment licensed pursuant to Section 1-1118
17
18 of Title 63 of the Oklahoma Statutes whose owner or employee
18
19 knowingly violates subsection D of Section 5-107 of Title 2 of the
19
20 Oklahoma Statutes shall have its license revoked upon the conviction
20
21 of an owner or employee for a violation of subsection D of Section
21
22 5-107 of Title 2 of the Oklahoma Statutes.

1 C. The Oklahoma Department of Agriculture, Food, and Forestry
1
2 shall promulgate rules necessary to implement the provisions of this
2
3 section.
3
4 SECTION 3. This act shall become effective November 1, 2025.
