7 An Act relating to unmanned aircraft systems;
7 defining terms; prohibiting certain use of unmanned
8 aircraft systems over certain property; providing
8 penalties for violation; prohibiting certain use of
9 unmanned aircraft systems with surveillance devices
9 over certain property; providing penalties for
10 violation; prescribing relief for certain violation;
10 authorizing the court to provide certain expenses
11 related to petition; allowing for certain use of
11 image, sound, or data following violation; exempting
12 certain uses; providing for promulgation of rules;
12 providing for codification; and providing an
13 effective date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17 SECTION 1. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 4-50 of Title 2, unless there is
18
19 created a duplication in numbering, reads as follows:
19
20 As used in this act:
20
21 1. "Animal feeding operation" means the same as defined in
21
22 Section 20-41 of Title 2 of the Oklahoma Statutes;
22
23 2. "Homestead" means real property that includes the principal
23
24 residence of a person and up to four hundred (400) feet of

1 surrounding land with any improvements, if all such real property is
1
2 both owned or leased by that person and is located outside a city or
2
3 town or outside any platted subdivision or addition;
3
4 3. "Intrusion" means operating an unmanned aircraft system at a
4
5 distance less than four hundred (400) feet above or alongside the
5
6 property. The distance shall be measured by the nearest point of a
6
7 property barrier or object within the property and the unmanned
7
8 aircraft system;
8
9 4. "Livestock" or "animals" means the same as defined in
9
10 Section 1-3 of Title 2 of the Oklahoma Statutes;
10
11 5. "Principal residence" means the place where a person
11
12 habitually lives for more days per year than another place in this
12
13 state, if the place is located outside a city or town or outside any
13
14 platted subdivision or addition;
14
15 6. "Secure farmstead area" means real property that includes an
15
16 animal feeding operation and up to four hundred (400) feet of
16
17 surrounding land with any improvements, if all such real property is
17
18 both owned or leased by a person and is located outside a city or
18
19 town or outside any platted subdivision or addition;
19
20 7. "Surveillance device" means a camera or electronic equipment
20
21 that transmits or records images, sounds, or data if the
21
22 transmission or recording is capable of reasonably identifying any
22
23 of the following:

1 a. the identity, physical appearance, conduct, or voice
1
2 of an individual,
2
3 b. the species of an agricultural animal, or
3
4 c. the unique physical characteristics of land or an
4
5 improvement upon the land; and
5
6 8. "Unmanned aircraft system" means the same as defined in
6
7 Section 82 of Title 3 of the Oklahoma Statutes.

8 SECTION 2. NEW LAW A new section of law to be codified
8
9 in the Oklahoma Statutes as Section 4-50.1 of Title 2, unless there
9
10 is created a duplication in numbering, reads as follows:
10
11 A. A person commits intrusion by the use of an unmanned
11
12 aircraft system if the person knowingly does any of the following:
12
13 1. Controls the flight of an unmanned aircraft system over a
13
14 homestead not owned or leased by the person piloting the unmanned
14
15 aircraft system and the unmanned aircraft system remains over the
15
16 homestead; or
16
17 2. Controls the flight of an unmanned aircraft system over a
17
18 secure farmstead area not owned or leased by the person piloting the
18
19 unmanned aircraft system and the unmanned aircraft system remains
19
20 over the secure farmstead area.
20
21 B. 1. A person who is convicted of violating this section
21
22 shall be guilty of a misdemeanor, punishable by imprisonment for not
22
23 more than thirty (30) days, or by a fine not less than Five Hundred

1 Dollars ($500.00) nor more than One Thousand Dollars ($1,000.00), or
1
2 by both such imprisonment and fine.

3 2. Notwithstanding the provisions of paragraph 1 of this
3
4 subsection, a person who is convicted of violating this section
4
5 shall be guilty of a misdemeanor, punishable by imprisonment for
5
6 more than one (1) year, or by a fine not less than One Thousand
6
7 Dollars ($1,000.00) nor more than Two Thousand Five Hundred Dollars
7
8 ($2,500.00), or by both such imprisonment and fine if the person has
8
9 previously been convicted of any of the following:
9
10 a. violating the provisions of this section, or
10
11 b. surveillance by use of an unmanned aircraft system
11
12 pursuant to Section 3 of this act.
12
13 SECTION 3. NEW LAW A new section of law to be codified
13
14 in the Oklahoma Statutes as Section 4-50.2 of Title 2, unless there
14
15 is created a duplication in numbering, reads as follows:
15
16 A. A person commits surveillance by the use of an unmanned
16
17 aircraft system if the person knowingly does any of the following:
17
18 1. Controls the flight of an unmanned aircraft system equipped
18
19 with a surveillance device over a homestead not owned or leased by
19
20 the person piloting the unmanned aircraft system and the unmanned
20
21 aircraft system remains over the homestead; or
21
22 2. Controls the flight of an unmanned aircraft system equipped
22
23 with a surveillance device over a secure farmstead area not owned or
23
24

1 leased by the person piloting the unmanned aircraft system and the
1
2 unmanned aircraft system remains over the secure farmstead area.
2
3 B. 1. A person who is convicted of violating this section
3
4 shall be guilty of a misdemeanor, punishable by imprisonment for
4
5 more than one (1) year, or by a fine not less than One Thousand
5
6 Dollars ($1,000.00) nor more than Two Thousand Five Hundred Dollars
6
7 ($2,500.00), or both such imprisonment and fine.
7
8 2. Notwithstanding the provisions of paragraph 1 of this
8
9 subsection, a person who is convicted of violating this section
9
10 shall be guilty of a misdemeanor, punishable by imprisonment for
10
11 more than two (2) years, or by a fine not less than Five Thousand
11
12 Dollars ($5,000.00) nor more than Ten Thousand Dollars ($10,000.00),
12
13 or by both such imprisonment and fine if the person has previously
13
14 been convicted of any of the following:
14
15 a. violating the provisions of Section 2 of this act, or
15
16 b. violating the provisions of this act.
16
17 SECTION 4. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 4-50.3 of Title 2, unless there
18
19 is created a duplication in numbering, reads as follows:
19
20 A. A person who is the owner or lessee of a homestead or secure
20
21 farmstead area may petition the district court to obtain an order
21
22 for a temporary injunction to prevent the respondent from using any
22
23 unmanned aircraft system equipped with a surveillance device, if a
23
24 preponderance of evidence indicates the respondent is harassing the

1 petitioner by controlling the flight of the unmanned aircraft system
1
2 over the person's homestead or secure farmstead area. The court
2
3 shall grant the temporary injunction for not more than two (2)
3
4 years. The court may continue the injunction upon a petition filed
4
5 by the petitioner with the court prior to the order's expiration.
5
6 B. If a court grants an order for a temporary injunction under
6
7 subsection A of this section, the court may award the petitioner
7
8 court costs, reasonable attorney fees, and expenses related to the
8
9 petitioner's investigation and adjudication of the case.
9
10 C. 1. Except as provided in subparagraph b of paragraph 2 of
10
11 this subsection, a court shall order that any person holding a
11
12 retrievable image, sound, or data recorded in violation of this
12
13 section destroy the image, sound, or data, including any copy of
13
14 such image, sound, or data.
14
15 2. a. A person may claim an ownership interest in a
15
16 retrievable image, sound, or data recorded in
16
17 violation of this section, to the extent that any of
17
18 the following apply:
18
19 (1) the person is an individual who may be identified
19
20 in the recording. A parent or guardian of the
20
21 individual may claim the ownership interest on
21
22 behalf of the individual,
22
23 (2) the person is an owner of the livestock that may
23
24 be identified in the recording, or

1 (3) the person is an owner of the land or an
1
2 improvement to land having unique physical
2
3 characteristics that may be identified in the
3
4 recording.

5 b. A person cannot claim an ownership interest in a
5
6 retrievable image, sound, or data that may identify
6
7 another individual, livestock owned by another person,
7
8 or land or an improvement owned by another person,
8
9 unless that other individual or person consents.
9
10 SECTION 5. NEW LAW A new section of law to be codified
10
11 in the Oklahoma Statutes as Section 4-50.4 of Title 2, unless there
11
12 is created a duplication in numbering, reads as follows:
12
13 A. A person shall not be in violation of this act if the person
13
14 piloting the unmanned aircraft system is:
14
15 1. A person acting with the consent of the owner of the
15
16 homestead or secure farmstead area;
16
17 2. A person operating an unmanned aircraft system for a
17
18 commercial or agricultural use in compliance with the Federal
18
19 Aviation Administration regulations, authorizations, or exemptions;
19
20 3. A department, agency, or unit of government of this state or
20
21 any other state, city, county, or political subdivision, or any
21
22 other public corporation or agency created under the laws of this
22
23 state, any other state, the United States, or any department or
23
24 agency thereof, or any agency, commission, or authority established

1 pursuant to an interstate company or agreement or combination
1
2 thereof;

3 4. A public utility as defined in Section 191.1 of Title 17 of
3
4 the Oklahoma Statutes;
4
5 5. A railroad company as defined in Section 2201 of Title 68 of
5
6 the Oklahoma Statutes;
6
7 6. The city, town, or political subdivision exercising rights
7
8 to a road pursuant to Section 1201 et seq. of Title 69 of the
8
9 Oklahoma Statutes; and
9
10 7. The owner or lessee of the homestead or secure farmstead
10
11 area.
11
12 B. The Oklahoma Department of Agriculture, Food, and Forestry
12
13 shall promulgate rules necessary to implement the provisions of this
13
14 act.

15 SECTION 6. This act shall become effective November 1, 2025.
