7 An Act relating to agriculture; creating Kenny's Law;
7 providing short title; defining terms; requiring
8 gates to remain closed at all times; allowing for
8 certain exceptions; providing for violations of this
9 act; prescribing penalties for violation; providing
9 for noncodification; providing for codification; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law not to be
14
15 codified in the Oklahoma Statutes reads as follows:
15
16 This act shall be known and may be cited as "Kenny's Law".
16
17 SECTION 2. NEW LAW A new section of law to be codified
17
18 in the Oklahoma Statutes as Section 2-34 of Title 2, unless there is
18
19 created a duplication in numbering, reads as follows:
19
20 A. As used in this act:
20
21 1. "Livestock" means the same as defined in Section 1-3 of
21
22 Title 2 of the Oklahoma Statutes; and
22
23 2. "Maintenance" means the functional checking, servicing,
23
24 repairing, or replacing of necessary infrastructure conducted by the

1 property owner, utility company, municipality, or state or federal

2 agency.

3 B. All gates that are part of an enclosure or barrier designed
3
4 to contain livestock shall remain closed at all times, except when:
4
5 1. Ingress or egress is in progress; provided, that the ingress
5
6 or egress shall be reasonable and not prolonged as to allow persons
6
7 to enter and leave without causing containment of livestock to be
7
8 compromised;
8
9 2. Maintenance is occurring within the property;
9
10 3. Livestock are being moved from one area to another; or
10
11 4. The livestock owner, utility company, municipality, or any
11
12 state or federal agency has a functional reason to access the
12
13 enclosed area.

14 C. A person shall be in violation of this act if he or she
14
15 knowingly and maliciously:
15
16 1. Leaves a gate open that is part of an enclosure or barrier
16
17 designed to contain livestock on private or public property;
17
18 2. Damages any part of a gate that is part of an enclosure or
18
19 barrier designed to contain livestock, which compromises the
19
20 containment of livestock; or
20
21 3. Allows livestock to escape containment.

22 D. Individuals in violation of this act shall be deemed guilty
22
23 of a misdemeanor and, upon conviction, shall be punished by a fine
23
24 no more than One Thousand Dollars ($1,000.00) for each separate

1 offense or imprisonment in a county jail for no more than one
1
2 hundred eighty (180) days for each separate offense, or by both fine
2
3 and imprisonment, for the first and second convictions. Third and
3
4 subsequent convictions for this violation shall be punished by no
4
5 more than Two Thousand Five Hundred Dollars ($2,500.00) for each
5
6 separate offense or imprisonment in a county jail for not more than
6
7 one (1) year for each separate offense, or by both fine and
7
8 imprisonment. Individuals in violation of this section shall also
8
9 incur all financial liability from damages caused.

10 E. The Oklahoma Department of Agriculture, Food, and Forestry
10
11 shall promulgate rules necessary to implement the provisions of this
11
12 act.

13 SECTION 3. This act shall become effective November 1, 2025.
