7   An Act relating to broker compensation; amending 59

7   O.S. 2021, Section 858-359, which relates to payment

8   to broker; authorizing offer of compensation for

8   certain services; providing certain exceptions; and

9   providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  59 O.S. 2021, Section 858-359, is

13

14 amended to read as follows:
14

15  Section 858-359. A. The payment or promise of payment or

15

16 compensation by a party to a broker does not determine what
16

17 relationship, if any, has been established between the broker and a
17

18 party to a transaction.

19  B. In the event a broker receives a fee or compensation from

19

20 any party to the transaction based on a selling price or lease cost
20

21 of a transaction, such receipt does not constitute a breach of duty
21

22 or obligation to any party to the transaction.

23  C. A broker or real estate owner of record may compensate or

23

24 offer compensation to any real estate professional licensed by the

1 Oklahoma Real Estate Commission for providing brokerage services in
1

2 connection with the purchase, lease, sale, transfer, or exchange of
2

3 real estate located in this state.

4   D. 1. Nothing in this section requires a broker to charge, or

4

5 prohibits a broker from charging, a separate fee or other
5

6 compensation for each duty or other brokerage services provided
6

7 during a transaction.

8   2. Nothing in this section requires a broker or real estate

8

9 owner of record to offer compensation to any real estate
9

10 professional in this state.

11  SECTION 2. This act shall become effective November 1, 2025.
