7   An Act relating to cemeteries; amending 8 O.S. 2021,

7   Section 143, which relates to maintenance and

8   improvement of certain cemeteries by county

8   commissioners; requiring certain utilization;

9   requiring certain county maintenance in certain

9   circumstances; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
12

13  SECTION 1.      AMENDATORY    8 O.S. 2021, Section 143, is

13

14 amended to read as follows:
14

15  Section 143. In any county of this state, the board of county

15

16 commissioners is hereby authorized and empowered to utilize
16

17 employees under its jurisdiction and county-owned tools, machinery,
17

18 equipment, and materials for the purposes of opening and closing
18

19 graves and maintaining and improving any publicly owned cemetery or
19

20 other cemetery within the county not owned and maintained by an
20

21 individual or private organization; provided, that, there is a
21

22 documented and known tribal burial presence, and where appropriate,
22

23 a reasonable fee, not to exceed the actual cost of the service, may
23

24 be charged for such services.

1   SECTION 2. This act shall become effective November 1, 2025.
