7 An Act relating to public health; defining term;
7 requiring certain perinatal mental health screenings;
8 directing certain disclosure of data; requiring the
8 State Department of Health to make available certain
9 website and application for perinatal resources;
9 authorizing certain survey and contracts; requiring
10 the Department to collect specified data; directing
10 compilation and publication of certain annual report;
11 providing for codification; and providing an
11 effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15 SECTION 1. NEW LAW A new section of law to be codified
15
16 in the Oklahoma Statutes as Section 1-242a.1 of Title 63, unless
16
17 there is created a duplication in numbering, reads as follows:
17
18 As used in this act, "perinatal period" means the period
18
19 beginning when a woman becomes pregnant and ending one (1) year
19
20 after the woman gives birth.

21 SECTION 2. NEW LAW A new section of law to be codified
21
22 in the Oklahoma Statutes as Section 1-242a.2 of Title 63, unless
22
23 there is created a duplication in numbering, reads as follows:

1 A. Any health care provider who conducts a visit with a mother
1
2 or infant during the perinatal period shall conduct a mental health
2
3 screening of the mother to check for signs of perinatal depression
3
4 and anxiety.

5 B. To the extent allowed under state and federal privacy laws,
5
6 health care providers shall share data with the State Department of
6
7 Health for the purpose of implementing Section 4 of this act.

8 SECTION 3. NEW LAW A new section of law to be codified
8
9 in the Oklahoma Statutes as Section 1-242a.3 of Title 63, unless
9
10 there is created a duplication in numbering, reads as follows:

11 A. The State Department of Health shall develop and make
11
12 available to the public a website and a mobile application that
12
13 provide information on programs, services, and other resources for
13
14 women and infants during the perinatal period. The information and
14
15 resources shall be designed to ease access to health care, mental
15
16 health services, public assistance programs, and other available
16
17 public and private supports and to improve maternal health, mental
17
18 health, and infant health outcomes.

19 B. The Department may use the website and application to
19
20 conduct a survey on maternal health, mental health, and infant
20
21 health for the purpose of fulfilling the requirements of Section 4
21
22 of this act.

23 C. The Department may enter into one or more contracts as
23
24 necessary to implement the provisions of this section.

2 in the Oklahoma Statutes as Section 1-242a.4 of Title 63, unless
2
3 there is created a duplication in numbering, reads as follows:

4 A. The State Department of Health shall collect data on
4
5 maternal health, mental health, and infant health outcomes through
5
6 available sources which may include, but shall not be limited to:
6
7 1. Data reported by health care providers under Section 2 of
7
8 this act;
8
9 2. Data obtained through surveys under Section 3 of this act;
9
10 and
10
11 3. Data obtained through the Behavioral Risk Factor
11
12 Surveillance System.
12
13 B. The Department shall compile the data into an annual report
13
14 on maternal health, mental health, and infant health outcomes that
14
15 includes incidence of perinatal depression and anxiety and
15
16 categorizes data by age, ethnicity, and other relevant demographic
16
17 factors.

18 C. The report shall be published on the Department's website
18
19 and shall be electronically submitted to the President Pro Tempore
19
20 of the Senate, the Speaker of the House of Representatives, and the
20
21 Governor.

22 SECTION 5. This act shall become effective November 1, 2025.
