6 An Act relating to contracts; creating the Predatory
6 Solicitation Prevention Act; providing short title;
7 defining term; prohibiting certain practice;
7 providing for fines and fees; directing deposit of
8 fine or fee to certain funds; providing for
8 noncodification; providing for codification; and
9 providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law not to be
12
13 codified in the Oklahoma Statutes reads as follows:
13
14 This act shall be known and may be cited as the "Predatory
14
15 Solicitation Prevention Act".
15
16 SECTION 2. NEW LAW A new section of law to be codified
16
17 in the Oklahoma Statutes as Section 1030 of Title 15, unless there
17
18 is created a duplication in numbering, reads as follows:

19 A. As used in this act, "predatory solicitation" means
19
20 persistent, repeated communication to solicit a purchase, sale, or
20
21 investment in real property and such communication is designed to
21
22 influence, harass, intimidate, aggravate, badger, or otherwise not
22
23 accept the property owner's ability to refuse.

1 B. No person or entity shall engage in the practice of

2 predatory solicitation in this state.
2
3 C. Any person or entity that engages in the practice of
3
4 predatory solicitation in this state shall be liable for a penalty
4
5 in the amount of Six Hundred Dollars ($600.00) per instance of
5
6 communication.

7 SECTION 3. NEW LAW A new section of law to be codified
7
8 in the Oklahoma Statutes as Section 1031 of Title 15, unless there
8
9 is created a duplication in numbering, reads as follows:

10 A. The Attorney General or a district attorney may bring an
10
11 action to recover actual damages and penalties as provided by this
11
12 act.
12
13 B. Of the monies collected under this act through an action of
13
14 the Attorney General:
14
15 1. Fifty percent (50%) shall be credited to the State Health
15
16 Care Enhancement Fund, created pursuant to Section 302-7a of Title
16
17 68 of the Oklahoma Statutes; and
17
18 2. Fifty percent (50%) shall be credited to the Court Clerk's
18
19 Revolving Fund, created pursuant to Section 220 of Title 19 of the
19
20 Oklahoma Statutes.

21 SECTION 4. This act shall become effective November 1, 2025.
