7 An Act relating to the Oklahoma Public Employees
7 Retirement System; amending 74 O.S. 2021, Section
8 911, which relates to employee members; allowing
8 certain employees to opt out of certain System
9 participation; and updating statutory language.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13 SECTION 1. AMENDATORY 74 O.S. 2021, Section 911, is
13
14 amended to read as follows:
14
15 Section 911. (1) A. Any employee of a participating employer
15
16 on the entry date of such employer shall be a member of the System
16
17 on the entry date.
17
18 (2) B. Any employee other than a state elected official who is
18
19 employed by a participating employer after the entry date of such
19
20 employer shall be a member of the System on the first day of the
20
21 month immediately following employment. Provided, any employee of a
21
22 participating employer shall have the option to opt out of
22
23 participating in the System's defined contribution with no penalty.

1 (3) C. Any employee who is in military service or on leave of

2 absence on the entry date of his employer shall become a member of
2
3 the System upon his return to active employment.
