7   An Act relating to initiative and referendum;

7   amending 34 O.S. 2021, Section 3, which relates to

8   petitions and signatures; making language gender

8   neutral; requiring Secretary of State to make

9   affirmation about certain language; and declaring an

9   emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  34 O.S. 2021, Section 3, is

13

14 amended to read as follows:
14

15  Section 3. A. Each initiative petition and each referendum

15

16 petition shall be duplicated for the securing of signatures. The
16

17 Secretary of State shall design a form, subject to change, for
17

18 signatures that shall be used by proponents of initiatives or
18

19 referendums when collecting signatures, and each sheet for
19

20 signatures shall be attached to a copy of the petition. Each copy
20

21 of the petition and sheets for signatures is hereinafter termed a
21

22 pamphlet. On the outer page of each pamphlet shall be printed the
22

23 word "Warning", and underneath this in ten-point type the words, "It
23

24 is a felony for anyone to sign an initiative or referendum petition

1 with any name other than his or her own, or knowingly to sign his or

2 her name more than once for the measure, or to sign such petition
2

3 when he or she is not a legal voter." A simple statement of the
3

4 gist of the proposition shall be printed on the top margin of each
4

5 signature sheet.

6   B. The Secretary of State shall affirm that any proposition,

6

7 suggested ballot title, or gist does not contain euphemisms, words,
7

8 or phrases regarded in popular parlance as code words, or an
8

9 apparent attempt to deceive voters.

10  SECTION 2. It being immediately necessary for the preservation

10

11 of the public peace, health or safety, an emergency is hereby
11

12 declared to exist, by reason whereof this act shall take effect and
12

13 be in full force from and after its passage and approval.
