7   An Act relating to administrative rules; requiring

7   revocation of certain rules upon certain permanent

8   rule adoption; providing penalty; defining terms;

8   providing for codification; and providing an

9   effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.      NEW LAW  A new section of law to be codified

12

13 in the Oklahoma Statutes as Section 303.3 of Title 75, unless there
13

14 is created a duplication in numbering, reads as follows:
14

15  A. 1. On and after the effective date of this act, and except

15

16 as otherwise prohibited by law, any state agency that adopts a
16

17 permanent rule pursuant to Section 303 of Title 75 of the Oklahoma
17

18 Statutes which contains a regulatory restriction shall submit two
18

19 regulatory restrictions for revocation.

20  2. Proposed revocations shall be included in the agency rule

20

21 report prescribed by Section 303.1 of Title 75 of the Oklahoma
21

22 Statutes.

1   B. Failure of an agency to comply with the provisions of this

2 section shall result in disapproval of all regulatory restrictions
2

3 proposed by the agency.

4   C. For the purposes of this section:

4

5   1. "Regulatory restriction" means any permanent rule that

5

6 includes the words "shall", "must", "require", "shall not", "may
6

7 not", and "prohibit"; and
7

8   2. "State agency" means a state agency as defined pursuant to

8

9 Section 250.3 of Title 75 of the Oklahoma Statutes.

10  SECTION 2. This act shall become effective November 1, 2025.
