7 An Act relating to health insurance; defining terms;
7 requiring coverage of certain anesthesia services;
8 providing for codification; and providing an
8 effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12 SECTION 1. NEW LAW A new section of law to be codified
12
13 in the Oklahoma Statutes as Section 7500 of Title 36, unless there
13
14 is created a duplication in numbering, reads as follows:

15 A. As used in this section:
15
16 1. "Anesthesia time" means the period beginning when an
16
17 anesthesia practitioner begins to prepare the patient for anesthesia
17
18 services in the operating room or an equivalent area and ends when
18
19 the anesthesia practitioner is no longer furnishing anesthesia
19
20 services to the patient. In counting anesthesia time for services
20
21 furnished, the anesthesia practitioner may include blocks of time
21
22 around an interruption in anesthesia time provided the anesthesia
22
23 practitioner is furnishing continuous anesthesia care within the
23
24 time periods around the interruption;

1 2. "Payments for anesthesia service" means the prevailing

2 medical coding and billing standards in the professional medical
2
3 billing community including, but not limited to, current AMA CPT
3
4 Codebook, Medicare Claims Processing Manual, and American Society of
4
5 Anesthesiologists guidance. Payment for anesthesia services is
5
6 based on base plus time unit together multiplied by an anesthesia
6
7 conversion factor. Anesthesia time units are recognized in
7
8 appropriate time intervals that must add up to the duration of the
8
9 anesthesia time; and

10 3. "Insurer" shall have the same meaning as defined in Section
10
11 1250.2 of Title 36 of the Oklahoma Statutes.

12 B. No insurer shall establish, implement, or enforce any
12
13 policy, practice, or procedure which:
13
14 1. Imposes a time limit on the amount of covered anesthesia
14
15 services provided during a medical or surgical procedure; or
15
16 2. Restricts or excludes coverage or payment of anesthesia
16
17 time.

18 SECTION 2. This act shall become effective November 1, 2025.
