7 An Act relating to the release of CO2; defining terms;
7 creating a CO2 victim lien; specifying terms of lien;
8 providing for perfection of lien; specifying filing
8 requirements; providing for termination of lien;
9 establishing provisions in the case of owner
9 bankruptcy; providing for codification; and providing
10 an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
14
15 in the Oklahoma Statutes as Section 3-9-101 of Title 27A, unless
15
16 there is created a duplication in numbering, reads as follows:

17 A. For the purposes of this section:

18 1. "Kill zone" means the area within a twenty-five mile radius
18
19 of the site of:
19
20 a. the rupture of a carbon dioxide (CO2) pipeline, or
20
21 b. the release of CO2 from a CO2 pipeline, facility, or
21
22 sequestration site;

1 2. "Owner" means any person that owns or operates a CO2 pipeline

2 or supplies CO2 to a CO2 pipeline, facility, or sequestration site;
2
3 and

4 3. "Victim" means any person that files a financing statement
4
5 for the purposes of perfecting a CO2 victim lien.
5
6 B. Any person residing, traveling through, visiting, or owning
6
7 or leasing property, agriculture, equipment, livestock, or pets, or
7
8 who is dependent on affected water sources located within the kill
8
9 zone of a CO2 pipeline, facility, or sequestration site shall have
9
10 claim to a CO2 victim lien. Such person shall have standing for
10
11 compensation for all damages incurred or projected to be incurred by
11
12 the person due to the rupture of a CO2 pipeline or the release of CO2
12
13 from a CO2 pipeline, facility, or sequestration site. The lien shall
13
14 include full compensatory and punitive damages against all assets of
14
15 the owner of a CO2 pipeline or an owner supplying CO2 to a CO2
15
16 pipeline at the time of the release of CO2 or the rupture of a CO2
16
17 pipeline or sequestration site, regardless of intent or liability.

18 C. 1. To perfect a CO2 victim lien, a person shall file a UCC-1
18
19 financing statement within one (1) year from the date of the release
19
20 of CO2 or the rupture of a CO2 pipeline or sequestration site with
20
21 the county clerk's office where the kill zone is located. A
21
22 perfected lien shall have priority retroactive to the date that the
22
23 CO2 was released or that the CO2 pipeline or sequestration site
23
24 ruptured or leaked and over any conflicting security interest or

1 lien, including those perfected prior to the effective date of this

2 act.

3 2. A financing statement filed pursuant to this subsection
3
4 shall indicate that the statement is being filed to perfect a CO2
4
5 victim lien. The financing statement shall remain effective until a
5
6 termination date is filed.

7 D. A victim shall file a termination statement within thirty
7
8 (30) days from the date that the victim receives a written demand
8
9 from an owner, or from the date that the owner performs all
9
10 obligations of the lien, whichever is later. The victim shall also
10
11 file a termination statement if the victim wishes to relinquish
11
12 rights to the CO2 victim lien.

13 E. If any owner at the subject of a CO2 victim lien is involved
13
14 in bankruptcy or receivership, the trustee, conservator, or court
14
15 responsible for reorganization or liquidation of the owner's assets
15
16 shall hold the assets in trust for the benefit of potential CO2
16
17 victim lienholders for a period not to exceed one (1) year from the
17
18 date of the owner's last day of operating the CO2 pipeline or the
18
19 owner's last day of creating CO2 to be supplied to a CO2 pipeline or
19
20 facility.

21 SECTION 2. This act shall become effective November 1, 2025.
