7 An Act relating to the Legislature; providing for
7 temporary replacement of member of the Legislature
8 who enters active duty in the Armed Forces of the
8 United States; specifying selection procedure and
9 qualifications; stipulating dates of services;
9 granting certain powers, privileges, and duties to
10 temporary acting member; precluding certain
10 compensation; defining term; providing for
11 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14 SECTION 1. NEW LAW A new section of law to be codified
15
15 in the Oklahoma Statutes as Section 450.3 of Title 74, unless there
16
16 is created a duplication in numbering, reads as follows:
17
17 A. A member of the Legislature who enters active duty in the
18
18 Armed Forces of the United States as a result of being called to
19
19 duty, drafted, or activated does not vacate the office held, but a
20
20 replacement may be selected to serve as temporary acting officer as
21
21 provided by this section if the member will be on active duty for
22
22 longer than thirty (30) days.

1 B. The member of the Legislature shall select a person to serve

2 as the temporary acting representative or senator, subject to
2
3 approval of the selection by a majority vote of the appropriate
3
4 house of the Legislature. The temporary acting representative or
4
5 senator must be:
5
6 1. A member of the same political party as the member being
6
7 temporarily replaced; and
7
8 2. Qualified for office under Article V of the Oklahoma
8
9 Constitution.

10 C. The temporary acting member of the Legislature shall begin
10
11 service on the date specified in writing by the member being
11
12 temporarily replaced as the date the member will enter active
12
13 military service.

14 D. A temporary acting member of the Legislature has all the
14
15 powers, privileges, and duties of the office and is entitled to the
15
16 same compensation, payable in the same manner and from the same
16
17 source, as the member who is temporarily replaced. The member who
17
18 is temporarily replaced shall not receive compensation during the
18
19 term of active military service.

20 E. A temporary acting member of the Legislature appointed under
20
21 this section shall perform the duties of office for the shorter
21
22 period of:

23 1. The term of the active military service of the member who is
23
24 temporarily replaced; or

1 2. The term of office of the member who is temporarily

2 replaced.

3 F. As used in this section, "Armed Forces of the United States"
3
4 means the United States Army, the United States Navy, the United
4
5 States Air Force, the United States Marine Corps, the United States
5
6 Coast Guard, the United States Space Force, any reserve or auxiliary
6
7 component of any of those services, or the National Guard.

8 SECTION 2. This act shall become effective November 1, 2025.
