7   An Act relating to water and water rights; amending

7   82 O.S. 2021, Section 105.13, as amended by Section

8   2, Chapter 367, O.S.L. 2024 (82 O.S. Supp. 2024,

8   Section 105.13), which relates to water permitting;

9   requiring certain soil moisture assessments prior to

9   surface water permit issuance; and providing an

10  effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13

14  SECTION 1.      AMENDATORY  82 O.S. 2021, Section 105.13, as

14

15 amended by Section 2, Chapter 367, O.S.L. 2024 (82 O.S. Supp. 2024,
15

16 Section 105.13), is amended to read as follows:
16

17  Section 105.13. A. 1. The Oklahoma Water Resources Board is

17

18 authorized to issue, in addition to regular permits, seasonal,
18

19 temporary, term, or provisional temporary permits at any time the
19

20 Board finds such issuance will not impair or interfere with domestic
20

21 uses or existing rights of prior appropriators and may do so even
21

22 where it finds no unappropriated water is available for a regular
22

23 permit. All seasonal, temporary, term, and provisional temporary
23

24 permits shall contain a provision making them subject to all rights

1 of prior appropriators. If any such permit is for water impounded
1

2 in any works for storage, diversion, or carriage of water, the
2

3 applicant must comply with the provisions of Section 105.21 of this
3

4 title.

5   2. Surface water withdrawal permits issued on and after the

5

6 effective date of this act shall be conditioned upon the measurement
6

7 of subsurface soil moisture content. Surface water permittees shall
7

8 conduct soil moisture assessments at intervals prescribed by the
8

9 Oklahoma Water Resources Board and report findings as part of the
9

10 compliance process. The Board shall establish moisture thresholds
10

11 based on regional hydrological and agricultural conditions, which
11

12 shall be publicly accessible.

13  B. Except as otherwise provided by this section, application,

13

14 notice, and administrative hearing as provided in Sections 105.9
14

15 through 105.12 of this title shall be required for all permits. A
15

16 provisional temporary permit may be immediately and summarily
16

17 granted upon administrative approval by the Executive Director.
17

18 Provisional temporary permits shall:
18

19  1. Not be effective for a period of more than ninety (90) days

19

20 except for the oil and natural gas industry;
20

21  2. Be granted at the discretion of the Board; and

21

22  3. Be subject to such terms, conditions, and rules promulgated

22

23 by the Board for such purposes.

1   C. The Executive Director of the Board may administratively

2 issue permits to use limited quantities of stream water. Notice,
2

3 procedures, and the maximum quantity authorized for limited quantity
3

4 stream water permits shall be in compliance with rules promulgated
4

5 by the Board. In no event shall the maximum quantity of water
5

6 authorized in a limited quantity stream water permit exceed the
6

7 amount of stream water that would otherwise be determined by the
7

8 Board pursuant to Section 105.12 of this title.

9   SECTION 2. This act shall become effective November 1, 2025.
