7 An Act relating to workplace safety; creating the
Oklahoma Health Care Workplace Incentive Safety Act;
8 requiring participating hospitals to review workplace
safety standards; creating the Oklahoma Health Care
9 Workplace Safety Committee; setting membership;
describing powers and duties; providing for
10 codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 1000 of Title 40, unless there
16 is created a duplication in numbering, reads as follows:
17 This act shall be known and may be cited as the "Oklahoma Health
18 Care Workplace Incentive Safety Act".
19 SECTION 2. NEW LAW A new section of law to be codified
20 in the Oklahoma Statutes as Section 1001 of Title 40, unless there
21 is created a duplication in numbering, reads as follows:
22 A. For all participating hospitals and health care systems
23 participating in this act, the Oklahoma Employment Security
24 Commission shall pay incentives pursuant to a system developed by

1 the Oklahoma Health Care Workplace Safety Committee, as created in
2 Section 3 of this act. The Committee shall develop and administer a
3 system for ensuring appropriate utilization and quality of workplace
4 safety by those providers who are reimbursed under this section.
5 The Oklahoma Employment Security Commission shall promulgate rules
6 to provide for the implementation of this section.
7 B. Beginning November 1, 2026, and each November thereafter,
8 the Committee shall assess whether each hospital has adopted a
9 formal policy to address workplace violence and submit the reporting
10 requirements to the Legislature.
11 SECTION 3. NEW LAW A new section of law to be codified
12 in the Oklahoma Statutes as Section 1002 of Title 40, unless there
13 is created a duplication in numbering, reads as follows:
14 A. The Oklahoma Health Care Workplace Safety Committee shall
15 consist of the following members:
16 1. State Commissioner of Health, or designee;
17 2. One health care human resource director to be appointed by
18 the Speaker of the Oklahoma House of Representatives;
19 3. One health care human resource director to be appointed by
20 the President Pro Tempore of the Oklahoma State Senate;
21 4. One representative from the Oklahoma Hospital Association;
22 5. The Chair of the State Board of Health, or designee; and
23 6. Four health care support staff to be appointed by the
24 Oklahoma Hospital Association.

1 B. The Committee shall:
2 1. Develop recommended workplace violence metrics after
3 evaluating available national standards, considering innovative
4 approaches, and accounting for variations across hospitals;
5 2. Determine whether any federal or private funds are available
6 to assist hospitals in lowering the number of incidents of workplace
7 violence;
8 3. Develop legislative recommendations; and
9 4. Submit annual reports to the Legislature.
10 SECTION 4. This act shall become effective November 1, 2026.
