7 An Act relating to the Oklahoma Health Care
Authority; amending 63 O.S. 2021, Section 5006, which
8 relates to the Authority's powers and duties;
requiring the Authority to use certain federal
9 immigration reporting systems; requiring the
Authority to report certain applicants to federal
10 agencies; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15 SECTION 1. AMENDATORY 63 O.S. 2021, Section 5006, is
16 amended to read as follows:
17 Section 5006. A. There is hereby created the Oklahoma Health
18 Care Authority. The Authority shall have the power and duty to:
19 1. Purchase health care benefits for Medicaid recipients, and
20 others who are dependent on the state for necessary medical care, as
21 specifically authorized by law;
22 2. Enter into contracts for the delivery of state-purchased
23 health care and establish standards and criteria which must be met

1 by entities to be eligible to contract with the Authority for the
2 delivery of state-purchased health care;
3 3. Develop a proposed standard basic health care benefits
4 package or packages to be offered by health services providers, for
5 Medicaid recipients;
6 4. Study all matters connected with the provision of state-
7 purchased and state-subsidized health care coverage;
8 5. Develop and submit plans, reports and proposals, provide
9 information and analyze areas of public and private health care
10 interaction pursuant to the provisions of the Oklahoma Health Care
11 Authority Act;
12 6. Serve as a resource for information on state-purchased and
13 state-subsidized health care access, cost containment and related
14 health issues;
15 7. Administer programs and enforce laws placed under the
16 jurisdiction of the Authority pursuant to the Oklahoma Health Care
17 Authority Act, and such other duties prescribed by law;
18 8. Collaborate with and assist the Insurance Commissioner in
19 the development of a Uniform Claim Processing System for use by
20 third-party payors and health care providers;
21 9. Collaborate with and assist the State Department of Health
22 with the development of licensure standards and criteria for prepaid
23 health plans; and

1 10. Exercise all incidental powers which are necessary and
2 proper to carry out the purposes of the Oklahoma Health Care
3 Authority Act.
4 B. 1. The Oklahoma Health Care Authority shall verify the
5 immigration status of all applicants to all programs by utilizing
6 the United States Citizenship and Immigration Services' Systematic
7 Alien Verification for Entitlements (SAVE) system, or its successor
8 system, prior to the approval of any benefit conferred by the
9 Oklahoma Health Care Authority.
10 2. Upon final determination that an applicant's SAVE status
11 does not indicate the person is lawfully in the United States, the
12 Authority shall notify the United States Immigration and Customs
13 Enforcement Agency of the applicant's unverifiable legal presence in
14 the United States.
15 3. For any application for child-only Medicaid benefits, the
16 Authority shall also verify the immigration status of the qualified
17 adult applying on behalf of the child through the SAVE system, or
18 its successor system, regardless of whether the qualified adult is
19 included as a beneficiary or applicant for assistance. A qualified
20 adult shall be any person who is allowed to apply for benefits on
21 behalf of the child, as determined by federal law.
22 4. Upon final determination that the qualified adult's SAVE
23 status does not indicate the person is lawfully in the United
24 States, the Authority shall notify the United States Immigration and

1 Customs Enforcement Agency of the qualified adult's unverifiable
2 legal presence in the United States.
3 B. C. All positions within the Authority shall be unclassified
4 until approval of the annual business and personnel plan submitted
5 by January 1, 1995, by the Governor and the Legislature. In the
6 annual business plan submitted January 1, 1995, the Board shall
7 include a personnel plan which shall list, describe and justify all
8 unclassified positions within the Authority and their compensation.
9 All other employees and positions shall be classified and subject to
10 the provisions of the Merit System of Personnel Administration as
11 provided in the Oklahoma Personnel Act.
12 SECTION 2. This act shall become effective October 1, 2026.
