6                   AS INTRODUCED

7   An Act relating to professions and occupations;

    amending 59 O.S. 2021, Section 1000.23, as amended by

8   Section 3, Chapter 225, O.S.L. 2025 (59 O.S. Supp.

    2025, Section 1000.23), which relates to the Oklahoma

9   Uniform Building Code Commission Act; authorizing the

    Commission to approve continuing education training

10  for code officials and persons in building trades

    affected by the codes adopted by the Oklahoma Uniform

11  Building Code Commission; modifying powers and duties

    of the Oklahoma Uniform Building Code Commission; and

12  providing an effective date.

16 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

17  SECTION 1.      AMENDATORY  59 O.S. 2021, Section 1000.23, as

18 amended by Section 3, Chapter 225, O.S.L. 2025 (59 O.S. Supp. 2025,

19 Section 1000.23), is amended to read as follows:

20  Section 1000.23. A. The Oklahoma Uniform Building Code

21 Commission shall have the power and the duty to review and adopt all

22 codes and standards for residential and commercial construction to

23 be used by all entities within this state. Codes and standards

1 adopted by the Commission shall be the minimum standards for

2 residential and commercial construction in this state.

3   B. All public projects shall abide by such minimum standards

4 and requirements; provided, nothing in the Oklahoma Uniform Building

5 Code Commission Act shall prevent or take away from state agencies

6 the authority to enact and enforce requirements containing higher

7 standards and requirements than such minimum standards and

8 requirements.

9   C. Municipalities and other political subdivisions shall abide

10 by such minimum standards and requirements; provided, nothing in the

11 Oklahoma Uniform Building Code Commission Act shall prevent or take

12 away from such municipalities and other political subdivisions the

13 authority to enact and enforce requirements containing higher

14 standards and requirements than such minimum standards and

15 requirements.

16  D. The Oklahoma Uniform Building Code Commission shall have the

17 power and duty to establish a continuing education and training and

18 certification process for all residential and commercial

19 construction industry personnel affected by the codes adopted by the

20 Commission, including, but not limited to, code officials, design

21 professionals, and trade workers. The regional training shall be

22 offered at no cost to state-licensed building code officials and

23 shall be funded from the funds received pursuant to Section 1000.25

24 of this title. A fee may be assessed to all participants other than

1 state-licensed code officials. When assessed, the fee shall be

2 limited to any cost directly associated with the training and shall

3 be remitted to the State Treasury pursuant to the Oklahoma Uniform

4 Building Code Commission Act. Such fees shall be deposited in the

5 Oklahoma Uniform Building Code Commission Revolving Fund and shall

6 be used solely for the purposes of the Oklahoma Uniform Building

7 Code Commission Act. Each code official operating in this state on

8 behalf of any state agency or any municipal or county office may

9 complete regional training and be issued a certificate of completion

10 by the Oklahoma Uniform Building Code Commission. The training and

11 certification applications, qualifications and procedures shall be

12 promulgated by rules of the Commission. The Commission may

13 establish forms and procedures to implement and administer the

14 provisions of this section.

15  E. 1. The Oklahoma Construction Industries Board shall

16 recognize and accept any training, coursework, or continuing

17 education program developed, approved, or provided by the Oklahoma

18 Uniform Building Code Commission as meeting the continuing education

19 requirements established in rules for:

20  a. building, electrical, plumbing, and mechanical

21  inspectors, and

22  b. any licensee regulated by the Oklahoma Construction

23  Industries Board whose scope of practice includes

24  application, interpretation, installation, or

1            enforcement of the statewide minimum building codes

2            adopted pursuant to the Oklahoma Uniform Building Code

3            Commission Act.

4   2. Training recognized under subsection E of this section shall

5 be deemed to satisfy the continuing education unit requirements for

6 renewal of certifications, registrations, or licenses issued by the

7 Oklahoma Construction Industries Board, provided the training is

8 approved by the Oklahoma Uniform Building Code Commission for

9 directly relating to:

10           a. the statewide minimum building codes adopted by the

11           Commission, or

12           b. the administration, inspection, or enforcement of such

13           codes.

14  3. The Oklahoma Construction Industries Board shall promulgate

15 rules necessary to implement the provisions of this section,

16 including procedures for verification, recording, and acceptance of

17 continuing education units as approved by and completed through the

18 Oklahoma Uniform Building Code Commission.

19  E. F. The Commission shall establish a workforce development

20 process with the purpose of increasing the number of available code

21 officials in Oklahoma. The Commission shall promulgate rules on the

22 workforce development applications, qualifications, forms, and

23 procedures to implement and administer the provisions of this

24 section.
