7   An Act relating to Oklahoma Department of Veterans

    Affairs; amending 72 O.S. 2021, Section 222, as

8   amended by Section 2, Chapter 42, O.S.L. 2024 (72

    O.S. Supp. 2025, Section 222); renaming and

9   reclassifying a fund; amending authorized revenues

    into fund; prohibiting state appropriations into

10  fund; exempting fund from certain actions; requiring

    the Oklahoma Department of Veterans Affairs to keep

11  certain records; requiring certain audits; requiring

    certain reports; providing an effective date; and

12  declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16  SECTION 1.      AMENDATORY  72 O.S. 2021, Section 222, as

17 amended by Section 2, Chapter 42, O.S.L. 2024 (72 O.S. Supp. 2025,

18 Section 222), is amended to read as follows:

19  A. There is hereby created in the State Treasury a revolving

20 fund an agency special account for the Oklahoma Department of

21 Veterans Affairs to be known as the "Oklahoma Department of Veterans

22 Affairs Revolving Nonappropriated Veteran Care Enterprise Fund".

23 The revolving fund agency special account shall consist of all funds

24 and monies received by the Oklahoma Department of Veterans Affairs,

1 its constituent institutions, and/or or the Oklahoma Veterans

2 Commission, from any gifts, contributions, bequests, individual

3 reimbursements fees for service except as otherwise provided by law,

4 and other sources of revenue, for the care or support of war

5 veterans discharged other than under dishonorable conditions, who

6 have been admitted and cared for at the Oklahoma Department of

7 Veterans Affairs Centers Homes at Ardmore, Claremore, Clinton,

8 Lawton/Ft. Sill, Norman, Sulphur or Sallisaw. Provided, no grants-

9 in-aid, reimbursements, or other revenue from the United States

10 government or any instrumentality of the United States government,

11 or state appropriations shall be deposited in the fund. Provided

12 further, nothing contained herein prohibits the establishment and

13 utilization of special agency accounts by the Oklahoma Department of

14 Veterans Affairs and its constituent institutions, as may be

15 approved by the Director of the Office of Management and Enterprise

16 Services, for receipt and disbursement of the personal funds of

17 Veteran Center Home patients and members residents and/or for

18 receipt and disbursement of charitable contributions and donations

19 for use by and for patients and members residents.

20  B. The revolving fund agency special account herein created

21 shall be used by the Oklahoma Department of Veterans Affairs to pay

22 for the care of war veterans discharged other than under

23 dishonorable conditions, in Veterans Centers Homes, to pay the

24 general operating expenses of the Veterans Centers Homes, including

1 the payment of salaries and wages of officials and employees, to pay

2 for the employee safety programs and incentive awards provided for

3 in Section 63.10a of this title, and to remodel, repair, construct,

4 build additions, modernize, or add improvements of domiciliary or

5 hospital buildings necessary for the care of veterans, including

6 tuberculosis, mentally ill or neuropsychiatric patients, but not

7 excluding others; and architectural plans, specifications, or other

8 costs pertinent thereto.

9   C. The Oklahoma Department of Veterans Affairs may transfer

10 monies from the revolving fund created in this section to the W.V.C.

11 Revolving Fund in the State Treasury.

12  D. All expenditures from the revolving fund shall be made upon

13 warrants issued by the State Treasurer based upon claims approved by

14 the Oklahoma Department of Veterans Affairs, as provided by law, and

15 filed with the Director of the Office of Management and Enterprise

16 Services for approval and payment agency special account are exempt

17 from the requirement of deposit in the State Treasury and from

18 disbursement through the Office of Management and Enterprise

19 Services.

20  D. The Oklahoma Department of Veterans Affairs shall:

21  1. Maintain accounting records for exempt funds on a basis

22 consistent with applicable federal requirements;

23  2. Submit quarterly informational reports to the Governor,

24 Speaker of the Oklahoma House of Representatives, the President Pro

1 Tempore of the Oklahoma State Senate, and the Director of Office of

2 Management and Enterprise Services identifying sources, amounts,

3 purposes, and expenditures of such funds; and

4   3. Remain subject to examination by the State Auditor and

5 Inspector and to all federal audit and compliance requirements.

6   SECTION 2. This act shall become effective July 1, 2026.

7   SECTION 3. It being immediately necessary for the preservation

8 of the public peace, health or safety, an emergency is hereby

9 declared to exist, by reason whereof this act shall take effect and

10 be in full force from and after its passage and approval.
