6 AS INTRODUCED
7 An Act relating to school athletics; defining terms;
providing school districts with exclusive control of
8 school facilities; authorizing a cause of action for
injunctive relief; amending 70 O.S. 2021, Section 8-
9 103.2, which relates to extramural athletic
competition for transfer students; removing automatic
10 ineligibility; requiring determination of rule
violation for student to be ineligible; providing for
11 codification; providing an effective date; and
declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15 SECTION 1. NEW LAW A new section of law to be codified
16 in the Oklahoma Statutes as Section 27-201 of Title 70, unless there
17 is created a duplication in numbering, reads as follows:
18 A. As used in this section:
19 1. "School athletic association" shall have the same meaning as
20 provided for in Section 27-102 of Title 70 of the Oklahoma Statutes;
21 2. "School facilities" means any property or building owned and
22 operated by a public school district including, but not limited to,
23 athletic fields, gymnasiums, courts, training facilities, practice
24 facilities, and weight rooms.

1 B. Notwithstanding any policy of a school athletic association,
2 a public school district shall have exclusive control over the use
3 of any school facilities.
4 C. Any public school district shall have a cause of action for
5 injunctive relief against any school athletic association that
6 attempts to limit or control the use of school facilities.
7 SECTION 2. AMENDATORY 70 O.S. 2021, Section 8-103.2, is
8 amended to read as follows:
9 Section 8-103.2. Except as otherwise provided, a A student who
10 enrolls, pursuant to the Education Open Transfer Act or pursuant to
11 Section 2 8-113 of this act title, in a school district in which the
12 student is not a resident shall not be eligible to participate in
13 school-related extramural athletic competition governed by the
14 Oklahoma Secondary School Activities Association for a period of one
15 (1) year from the first day of attendance at the receiving school
16 unless the transfer is from a school district which does not offer
17 the grade the student is entitled to pursue. If the student is
18 granted an emergency transfer pursuant to Section 8-104 of this
19 title, was granted a transfer for any reason prior to January 1,
20 2000, or enrolls pursuant to the Education Open Transfer Act and
21 qualifies for a hardship waiver pursuant to the rules of the
22 Oklahoma Secondary School Activities Association, eligibility to
23 participate in school-related extramural athletic competition shall
24 be determined by the Oklahoma Secondary School Activities

1 Association unless the student is determined, after a formal due
2 process hearing, to be ineligible for violation of a specific rule
3 based on substantial evidence of any governing school athletic
4 association.
5 SECTION 3. This act shall become effective July 1, 2026.
6 SECTION 4. It being immediately necessary for the preservation
7 of the public peace, health or safety, an emergency is hereby
8 declared to exist, by reason whereof this act shall take effect and
9 be in full force from and after its passage and approval.
