8 An Act relating to state identification; amending 47
O.S. 2021, Section 6-105.3, as last amended by
9 Section 4, Chapter 330, O.S.L. 2025 (47 O.S. Supp.
2025, Section 6-105.3), which relates to
10 identification cards for Oklahoma residents;
prohibiting identification card fees for Oklahoma
11 high school students; defining term.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15 SECTION 1. AMENDATORY 47 O.S. 2021, Section 6-105.3, as
16 last amended by Section 4, Chapter 330, O.S.L. 2025 (47 O.S. Supp.
17 2025, Section 6-105.3), is amended to read as follows:
18 Section 6-105.3. A. In addition to the licenses to operate
19 motor vehicles, Service Oklahoma may issue cards to Oklahoma
20 residents for purposes of identification only. The identification
21 cards shall be issued, renewed, replaced, canceled and denied in the
22 same manner as driver licenses in this state. Provided, any person
23 who holds both a driver license and identification card from
24 Oklahoma as of November 1, 2025, may continue to possess both

1 credentials until the first expiration of either credential. At
2 that time, the person shall be allowed to retain, replace, or renew
3 either the driver license or identification card and shall surrender
4 the second credential to Service Oklahoma. A licensee whose record
5 reflects a notation of the person's proof of legal presence,
6 verified by the U.S. Department of Homeland Security, or proof of
7 U.S. citizenship, may obtain a REAL ID Compliant Identification Card
8 or a Noncompliant Identification Card from a licensed operator or
9 Service Oklahoma, regardless of the status of the license held by
10 the licensee. Provided, the licensee must comply with all REAL ID
11 documentation requirements to obtain a REAL ID Compliant
12 Identification Card. A person shall not apply for or possess more
13 than one state-issued or territory-issued REAL ID Compliant
14 Identification Card pursuant to the provisions of Section 6-101 of
15 this title.
16 The application for an identification card by any person under
17 the age of eighteen (18) years shall be signed and verified by a
18 custodial legal parent or legal guardian, either in person before a
19 person authorized to administer oaths or electronically if
20 completing an online application, or a notarized affidavit signed by
21 a custodial legal parent or legal guardian submitted before a person
22 authorized to administer oaths by the person under the age of
23 eighteen (18) years with the application. Except as otherwise
24 provided in this section, the identification cards shall be valid

1 for a period of either four (4) years from the month of issuance or
2 eight (8) years from the month of issuance; however, the
3 identification cards issued to persons sixty-five (65) years of age
4 or older shall be valid indefinitely from the month of issuance.
5 B. 1. The Department of Corrections shall coordinate with
6 Service Oklahoma to provide REAL ID Noncompliant Identification
7 Cards to all inmates who do not have a current state-issued
8 identification card or driver license upon their release from
9 custody. The identification cards shall be issued, replaced,
10 canceled and denied in the same manner as driver licenses in this
11 state.
12 2. Service Oklahoma shall allow the use of a certified copy of
13 a birth certificate coupled with a Department of Corrections-issued
14 consolidated record card to serve as a valid form of photo
15 identification documentation to obtain a REAL ID Noncompliant
16 Identification Card.
17 3. REAL ID Noncompliant Identification Cards issued with a
18 consolidated record card from the Department of Corrections for
19 inmates shall be valid for a period of four (4) years from the month
20 of issuance for an allowable fee to be determined by Service
21 Oklahoma and are nonrenewable and nontransferable.
22 4. The fee charged for the issuance or replacement of a REAL ID
23 Noncompliant Identification Card pursuant to this subsection shall
24 be deposited in the Department of Public Safety Revolving Fund

1 through October 31, 2022. Beginning November 1, 2022, this fee
2 shall be deposited in the Service Oklahoma Revolving Fund.
3 Provided, however, REAL ID Noncompliant Identification Cards issued
4 to individuals required to register pursuant to the Sex Offenders
5 Registration Act shall only be valid for a period of one (1) year.
6 No person sixty-five (65) years of age or older shall be charged a
7 fee for a REAL ID Noncompliant Identification Card.
8 5. No Oklahoma student ages fourteen (14) to eighteen (18)
9 shall be charged a fee for a REAL ID Noncompliant Identification
10 Card. For purposes of this section, "student" means a person
11 enrolled in ninth, tenth, eleventh, or twelfth grade in a public,
12 private, or other school, or educated by other means and receiving
13 instruction equivalent to ninth, tenth, eleventh, or twelfth grade,
14 within the State of Oklahoma.
15 6. Service Oklahoma is authorized to promulgate rules and
16 procedures to implement the provisions of this subsection.
17 C. No person shall hold more than one state-issued or
18 territory-issued driver license or identification card, as defined
19 in subsection G of Section 6-101 of this title. Service Oklahoma
20 shall not issue an identification card to any applicant who has been
21 previously issued a driver license or identification card unless
22 such license or identification card has been surrendered to Service
23 Oklahoma by the applicant. Provided, any person who holds both a
24 driver license and identification card from Oklahoma as of November

1 1, 2025, may continue to possess both credentials until the first
2 expiration of either credential. At that time, the person shall be
3 allowed to retain, replace, or renew either the driver license or
4 identification card and shall surrender the second credential to
5 Service Oklahoma. Service Oklahoma may promulgate rules related to
6 the issuance of replacement REAL ID Compliant Identification Cards
7 in the event of loss or theft.
8 D. The fee charged for the issuance or renewal of a REAL ID
9 Compliant Identification Card shall be Twenty-five Dollars ($25.00)
10 for a 4-year card and Fifty Dollars ($50.00) for an 8-year card.
11 The fee charged for the issuance or renewal of a REAL ID
12 Noncompliant Identification Card pursuant to this section shall be
13 Twenty-five Dollars ($25.00) for a 4-year card and Fifty Dollars
14 ($50.00) for an 8-year card; however, no person sixty-five (65)
15 years of age or older, student as described in paragraph 5 of
16 subsection B of this section, or one hundred percent (100%) disabled
17 veteran described in subsection P of Section 6-101 of this title
18 shall be charged a fee for an identification card. Of each fee
19 charged pursuant to the provisions of this subsection:
20 1. Seven Dollars ($7.00) of a 4-year card and Fourteen Dollars
21 ($14.00) of an 8-year card shall be apportioned as provided in
22 Section 1104 of this title;
23 2. Three Dollars ($3.00) of a 4-year card and Six Dollars
24 ($6.00) of an 8-year card shall be credited to the Department of

1 Public Safety Computer Imaging System Revolving Fund to be used
2 solely for the purpose of the administration and maintenance of the
3 computerized imaging system of the Department through October 31,
4 2022. Beginning November 1, 2022, Three Dollars ($3.00) of a 4-year
5 card and Six Dollars ($6.00) of an 8-year card shall be credited to
6 the Service Oklahoma Computer Imaging System Revolving Fund to be
7 used solely for the purpose of administration and maintenance of the
8 computerized imaging system of Service Oklahoma;
9 3. Ten Dollars ($10.00) of a 4-year card and Twenty Dollars
10 ($20.00) of an 8-year card shall be deposited in the Department of
11 Public Safety Revolving Fund through October 31, 2022. Beginning
12 November 1, 2022, this fee shall be deposited in the Service
13 Oklahoma Revolving Fund;
14 4. Three Dollars ($3.00) of a 4-year card and Six Dollars
15 ($6.00) of an 8-year card shall be deposited to the State Public
16 Safety Fund created in Section 2-147 of this title; and
17 5. Two Dollars ($2.00) for a 4-year card and Four Dollars
18 ($4.00) for an 8-year card of the fee authorized by this subsection
19 related to the issuance or renewal of an identification card by a
20 licensed operator that does process approved applications or
21 renewals for REAL ID Compliant and REAL ID Noncompliant Driver
22 Licenses or Identification Cards shall be retained by the licensed
23 operator pursuant to subsection E of Section 1141.1 of this title.

1 E. The fee charged for replacement of a REAL ID Compliant
2 Identification Card, or REAL ID Noncompliant Identification Card,
3 shall be Twenty-five Dollars ($25.00); however, no person sixty-five
4 (65) years of age or older, nor any student as described in
5 paragraph 5 of subsection B of this section, shall be charged a fee
6 for an identification card replacement. Of each fee charged
7 pursuant to the provisions of this subsection:
8 1. Seven Dollars ($7.00) shall be apportioned as provided in
9 Section 1104 of this title;
10 2. Three Dollars ($3.00) shall be credited to the Department of
11 Public Safety Computer Imaging System Revolving Fund to be used
12 solely for the purpose of the administration and maintenance of the
13 computerized imaging system of the Department through October 31,
14 2022. Beginning November 1, 2022, Three Dollars ($3.00) shall be
15 credited to the Service Oklahoma Computer Imaging System Revolving
16 Fund to be used solely for the purpose of administration and
17 maintenance of the computerized imaging system of Service Oklahoma;
18 3. Ten Dollars ($10.00) shall be deposited in the Department of
19 Public Safety Revolving Fund through October 31, 2022. Beginning
20 November 1, 2022, this fee shall be deposited in the Service
21 Oklahoma Revolving Fund;
22 4. Three Dollars ($3.00) shall be deposited to the State Public
23 Safety Fund created in Section 2-147 of this title; and

1 5. Two Dollars ($2.00) of the fee authorized by this subsection
2 related to the replacement of an identification card by a licensed
3 operator that does process approved applications or renewals for
4 REAL ID Compliant or REAL ID Noncompliant Driver Licenses or
5 Identification Cards shall be retained by the licensed operator
6 pursuant to subsection E of Section 1141.1 of this title.
7 F. The Oklahoma Tax Commission is hereby authorized to
8 reimburse, from funds available to that agency, each licensed
9 operator issuing an identification card to a person sixty-five (65)
10 years of age or older, an amount not to exceed One Dollar ($1.00)
11 for each card or driver license so issued through June 30, 2023.
12 The Tax Commission shall develop procedures for claims for
13 reimbursement.
14 G. Notwithstanding any other provision of law, when a person
15 makes application for a new identification card, or makes
16 application to renew an identification card, and the person has been
17 convicted of, or received a deferred judgment for, any offense
18 required to register pursuant to the Sex Offenders Registration Act,
19 the identification card shall be valid for a period of one (1) year
20 from the month of issuance, but may be renewed yearly during the
21 time the person is subject to registration on the Sex Offender
22 Registry. The cost for such identification card shall be the same
23 as for other identification cards and renewals.

1 H. Nothing in this section requires or authorizes the
2 Department of Public Safety to issue a REAL ID Noncompliant
3 Identification Card without the documentation required by the
4 provisions of paragraph 9 of subsection A of Section 6-103 of this
5 title.
