6                               AS INTRODUCED

7   An Act relating to crimes and punishments; amending

    21 O.S. 2021, Sections 1704 and 1706, which relate to

8   grand and petit larceny; decreasing threshold amount

    for grand larceny offenses; providing felony penalty

9   for third and subsequent petit larceny convictions;

    and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      AMENDATORY        21 O.S. 2021, Section 1704, is

15 amended to read as follows:

16  Section 1704. Grand larceny is larceny committed in either of

17 the following cases:

18  1. When the property taken is of a value of One Thousand

19 Dollars ($1,000.00) Five Hundred Dollars ($500.00) or greater; or

20  2. When such property, although not of a value of One Thousand

21 Dollars ($1,000.00) Five Hundred Dollars ($500.00) or greater, is

22 taken from the person of another.

23  Larceny in other cases is petit larceny.

1   SECTION 2.      AMENDATORY  21 O.S. 2021, Section 1706, is

2 amended to read as follows:

3   Section 1706. A. Petit larceny shall be punishable by a fine

4 of not less than Ten Dollars ($10.00) or more than Five Hundred

5 Dollars ($500.00), or imprisonment in the county jail not to six (6)

6 months, or by both such fine and imprisonment, at the discretion of

7 the court.

8   B. Any person convicted of a third or subsequent offense of

9 petit larceny shall be guilty of a felony, punishable by

10 imprisonment in the custody of the Department of Corrections for a

11 term not exceeding two (2) years, or a fine not exceeding One

12 Thousand Dollars ($1,000.00), or by both such fine and imprisonment.

13  SECTION 3. This act shall become effective November 1, 2026.
