6 AS INTRODUCED
7 An Act relating to newspapers and public notices;
exempting governmental entities from liability if
8 they comply with statutory publication requirements
and deadlines but the newspaper fails to correctly
9 publish notice; permitting good faith electronic
publication; providing for codification; and
10 providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 116 of Title 25, unless there is
16 created a duplication in numbering, reads as follows:
17 If the State of Oklahoma or any political subdivision thereof
18 properly submits a legal notice, advertisement, or publication to a
19 newspaper for publishing and such governmental entity has otherwise
20 met all statutory publication requirements and deadlines, it shall
21 not be liable for failing to comply with publication deadlines
22 provided by law or administrative rule in the event that a newspaper
23 fails to correctly publish such legal notice, advertisement, or
24 publication. The electronic publication of such legal notice,

1 advertisement, or publication may be used in conjunction with any
2 publication method the governmental entity determines in good faith
3 is feasible to meet the notice requirements.
4 SECTION 2. This act shall become effective November 1, 2026.
