6                            AS INTRODUCED

7   An Act relating to vulnerable juveniles and adults;

    defining terms; prohibiting the Oklahoma Juvenile

8   Authority, county juvenile detention centers, and the

    Oklahoma Department of Human Services from hiring

9   temporary staff members from certain agencies;

    providing for codification; and providing an

10  effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      NEW LAW  A new section of law to be codified

15 in the Oklahoma Statutes as Section 2-7-301.1 of Title 10A, unless

16 there is created a duplication in numbering, reads as follows:

17  A. As used in this section:

18  1. "Contracting organization" means an organization which

19 operates under a written agreement signed between the Oklahoma

20 Juvenile Authority, Oklahoma Health Care Authority, or Department of

21 Human Services and an organization that provided direct care

22 workers, rather than full-time direct hire staff, to post-

23 adjudication treatment facilities, residential care facilities

24 including Intermediate Care Facilities for individuals with

1 intellectual disabilities (ICF-IID), Daily Living Supports (DLS)

2 home or group homes;

3   2. "Temporary agency" means staffing agencies, part-time

4 staffing agencies, recruiting agencies, or other organizations that

5 provide employees on a temporary basis; and

6   3. "Vulnerable person" means any person under the age of

7 eighteen (18) or person having an intellectual disability.

8   B. Under no circumstances shall a group home, Intermediate Care

9 Facility for individuals with intellectual disabilities, Daily

10 Living Supports (DLS) home, post-adjudication treatment facility, or

11 any other facility holding youth operated by the Oklahoma Juvenile

12 Authority, Department of Human Services, or contracted with the

13 Oklahoma Health Care Authority, utilize, employ, or enter into an

14 agreement to staff facilities using organizations known as temporary

15 agencies or contracting organizations who employ full- or part-time

16 team members on behalf of the Oklahoma Juvenile Authority,

17 Department of Human Services, or the Oklahoma Health Care Authority

18 on a temporary or contract basis.

19  SECTION 2.      NEW LAW  A new section of law to be codified

20 in the Oklahoma Statutes as Section 458.1 of Title 19, unless there

21 is created a duplication in numbering, reads as follows:

22  A. As used in this section:

23  1. "Contracting organization" means an organization which

24 operates under a written agreement signed between the Oklahoma

1 Juvenile Authority and an organization that provided contract

2 workers, rather than full-time direct hire staff, to post-

3 adjudication treatment facilities; and

4   2. "Temporary agency" means staffing agencies, part-time

5 staffing agencies, recruiting agencies, or other organizations that

6 provide employees on a temporary basis.

7   B. Under no circumstances shall county juvenile detention

8 centers utilize, employ, or enter into an agreement to staff

9 detention facilities using organizations known as temporary agencies

10 or contracting organizations who employ full- or part-time team

11 members to the county on a contract basis.

12  SECTION 3.      NEW LAW  A new section of law to be codified

13 in the Oklahoma Statutes as Section 530.9 of Title 56, unless there

14 is created a duplication in numbering, reads as follows:

15  A. As used in this section:

16  1. "Contracting organization" means an organization which

17 operates under a written agreement signed between the Oklahoma

18 Juvenile Authority and an organization that provided contract

19 workers, rather than full-time direct hire staff, to post-

20 adjudication treatment facilities; and

21  2. "Temporary agency" means staffing agencies, part-time

22 staffing agencies, recruiting agencies, or other organizations that

23 provide employees on a temporary basis.

1   B. Under no circumstances shall an adult companion home

2 certified by the Oklahoma Department of Human Services utilize,

3 employ, or enter into an agreement to staff facilities using

4 organizations known as temporary agencies or contracting

5 organizations who employ full- or part-time team members to the

6 Department or contract basis.

7   SECTION 4. This act shall become effective November 1, 2026.
