7 An Act relating to continuum of care and assisted
living; creating the Providers' Bill of Rights Act of
8 2026; establishing what the Providers' Bill of Rights
contains; providing for codification; and providing
9 an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 1-896 of Title 63, unless there
16 is created a duplication in numbering, reads as follows:
17 This act shall be known and may be cited as the "Providers' Bill
18 of Rights Act of 2026".
19 SECTION 2. NEW LAW A new section of law to be codified
20 in the Oklahoma Statutes as Section 1-896.1 of Title 63, unless
21 there is created a duplication in numbering, reads as follows:
22 A. Each assisted living facility shall post the Providers' Bill
23 of Rights in a prominent place in the facility.

1 B. The Providers' Bill of Rights shall provide, as defined
2 under the Continuum of Care Act, the right to:
3 1. Be shown consideration and respect that recognizes the
4 dignity and individuality of the provider and assisted living
5 facility;
6 2. Terminate a resident's contract for just cause pursuant to
7 OAC 310:663-3-5 after a written thirty-day notice;
8 3. Terminate a contract immediately, if the provider finds that
9 it is mandated by the resident's immediate health needs or necessary
10 for the physical safety of the resident or of other residents;
11 4. Present grievances, file complaints, or provide information
12 to state agencies or other persons without threat of reprisal or
13 retaliation;
14 5. Refuse to perform services for the resident or the
15 resident's family other than those contracted for by the resident
16 and the provider;
17 6. Contract with the community to achieve the highest level of
18 independence, autonomy, interaction, and services to residents;
19 7. Obtain and request any relevant information or records of a
20 consumer referred to the facility in order to assess for appropriate
21 placement, which shall remain confidential as provided by law;
22 8. Refuse a consumer referred to the facility if the referral
23 is inappropriate;
24 9. Refuse to provide any information to third-party providers;

1 10. Maintain an environment free of weapons and drugs;
2 11. Be made aware of a resident's history, including self-
3 abuse, violent behavior, alcoholism, or drug abuse; and
4 12. Be made aware if a resident has contracted, arranged or is
5 being provided with a sitter or any other provider of personal
6 services in his or her personal apartment pursuant to Section 1-
7 890.8 of Title 63 of the Oklahoma Statutes.
8 SECTION 3. This act shall become effective November 1, 2026.
