6                            AS INTRODUCED

7   An Act relating to crimes and punishments; making

    certain acts unlawful; providing penalties; providing

8   forfeiture actions for seized property; providing for

    codification; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      NEW LAW  A new section of law to be codified

14 in the Oklahoma Statutes as Section 1796 of Title 21, unless there

15 is created a duplication in numbering, reads as follows:

16  Any alien or person who is not a citizen of the United States

17 who has unlawfully acquired title to or owns land in this state

18 either directly or indirectly through a business entity, trust, or

19 foreign government enterprise, and who uses such land to commit a

20 felony offense in violation of state law shall, upon conviction, be

21 guilty of a felony punishable by imprisonment in the custody of the

22 Department of Corrections for a term not to exceed two (2) years, or

23 by a fine not to exceed One Thousand Dollars ($1,000.00), or by both

24 such fine and imprisonment. In addition, all property seized

1 pursuant to this section shall be subject to the forfeiture

2 provisions provided for in Section 1738 of Title 21 of the Oklahoma

3 Statutes.

4   SECTION 2. It being immediately necessary for the preservation

5 of the public peace, health or safety, an emergency is hereby

6 declared to exist, by reason whereof this act shall take effect and

7 be in full force from and after its passage and approval.
