6                               AS INTRODUCED

7   An Act relating to elections; amending 26 O.S. 2021,

    Section 1-110, which relates to changes in party

8   affiliation; directing the State Election Board to

    notify registered voters of a political party which

9   ceases to be recognized that the voter must file a

    form and select a new affiliation to remain

10  registered; directing the State Election Board to

    notify registered voters of a political organization

11  which ceases to be recognized that the voter must

    file a form and select a new affiliation to remain

12  registered; stipulating that voters shall have ninety

    days to file the required form; amending 26 O.S.

13  2021, Section 4-112, as amended by Section 18,

    Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2025, Section

14  4-112), which relates to registration applications;

    requiring all applications for voter registration to

15  list a recognized political party affiliation or an

    Independent designation; prohibiting the State

16  Election Board from choosing for an applicant a party

    or Independent affiliation; requiring notification of

17  incomplete registration; and providing an effective

    date.

21 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

22  SECTION 1.      AMENDATORY  26 O.S. 2021, Section 1-110, is

23 amended to read as follows:

1   Section 1-110. A. The Secretary of the State Election Board

2 shall, within sixty (60) days after such proclamation by the State

3 Election Board, change to Independent the party affiliation in the

4 Oklahoma Election Management System of notify each registered voter

5 of a political party which ceases to be a recognized political party

6 that the voter must file a form, provided by the State Election

7 Board, selecting a new party or political organization affiliation,

8 or an Independent designation, to remain registered to vote.

9   B. The Secretary of the State Election Board shall change to

10 Independent the party affiliation in the Oklahoma Election

11 Management System of notify each registered voter of a political

12 organization which ceases to be a political organization that the

13 voter must file a form, provided by the State Election Board,

14 selecting a new party or political organization affiliation to

15 remain registered to vote.

16  C. Voters required to file a form under this section shall have

17 ninety (90) days from receipt of notice to file.

18  SECTION 2.      AMENDATORY  26 O.S. 2021, Section 4-112, as

19 amended by Section 18, Chapter 282, O.S.L. 2022 (26 O.S. Supp. 2025,

20 Section 4-112), is amended to read as follows:

21  Section 4-112. A. The Secretary of the State Election Board

22 shall devise and distribute a registration application form to be

23 used for registering voters. Such registration application shall

24 contain the following information:

1   1. The applicant's full name and date of birth, county and

2 place of residence, and mailing address pursuant to the provisions

3 of subsection G of this section;

4   2. A space or section to designate a political party recognized

5 by the laws of the State of Oklahoma with which the applicant

6 chooses to be affiliated;

7   3. The Oklahoma driver license or identification card number if

8 the applicant has been issued a current and valid driver license or

9 identification card by Service Oklahoma, or if the applicant does

10 not have a valid Oklahoma driver license or identification card, the

11 last four digits of the voter's Social Security number;

12  4. An oath of the eligibility of the applicant to become a

13 registered voter; and

14  5. Such other information as may be deemed necessary by the

15 Secretary to identify such applicant and to ascertain his or her

16 eligibility.

17  B. A voter registration application shall be signed by the

18 applicant in writing. The applicant shall personally subscribe his

19 or her name to or make his or her mark on the application, and no

20 agent, representative or employee of the applicant may sign or mark

21 on the applicant's behalf. The signature or mark must be the

22 original, handwritten signature, autograph or mark of the applicant.

23 No facsimile, reproduction, typewritten or other substitute

24 signature, autograph or mark will be valid. Notwithstanding any law

1 to the contrary, the Secretary of the State Election Board shall

2 prescribe procedures to authorize any person incapable of personally

3 making a mark to complete a voter registration application with

4 assistance of an official of any voter registration agency or

5 licensed operator specified in Sections 4-109.2 and 4-109.3 of this

6 title. Provided, for applications submitted electronically, in lieu

7 of the signature requirements set forth in this subsection, the

8 applicant shall consent to the use of his or her driver license or

9 identification card signature as provided in Section 4-109.4 of this

10 title.

11  C. Persons who do not indicate a recognized political party or

12 political organization on their registration application, or select

13 an Independent designation, shall not be designated as Independents

14 deemed to have completed their registration. The State Election

15 Board shall not choose a party for any person who has failed to list

16 how he or she would like to register and shall notify the applicant

17 that he or she must choose before his or her registration may be

18 completed.

19  D. Any person may apply in writing to the Secretary of the

20 State Election Board for permission to print, copy or otherwise

21 prepare and distribute the registration applications designed by the

22 Secretary of the State Election Board. The Secretary may revoke any

23 such permission at any time.

1   E. All registration applications shall be distributed to the

2 public at no charge.

3   F. The Secretary also shall prescribe procedures to accept and

4 use the National Mail Voter Registration Form, or its successor, as

5 required by the National Voter Registration Act of 1993. Provided,

6 to be accepted as a valid voter registration application, the form

7 shall include the applicant's original, handwritten signature,

8 autograph or mark as described in subsection B of this section.

9   G. Applicants for voter registration or for change of voter

10 registration in any way shall provide a residence address and, if

11 different from the residence address, a mailing address. A

12 residence address shall include the street address of the residence,

13 including a full house number, street name or number, apartment or

14 suite number, if applicable, and zip code. If a street address is

15 not available for the residence, applicants shall provide such

16 information as the Secretary of the State Election Board deems

17 necessary for voter registration purposes. A post office box may

18 not be given as a residence address. A mailing address, which shall

19 include the city and zip ZIP code, may be the actual emergency

20 notification or 911 address on file in the local community, a rural

21 route and box number, a post office box number or a street address.

22  H. A full or partial Social Security number or driver license

23 number in a voter registration record or a voter registration

24 application shall not be considered a public record and shall be

1 kept confidential by the State Election Board and each county

2 election board.

3   SECTION 3. This act shall become effective January 1, 2027.
