7   An Act relating to schools; requiring school district

    to spend certain percentage of budget on

8   instructional expenditures; providing definition of

    instructional expenditures; prohibiting

9   extracurricular activities during the school day for

    noncompliance; defining term; providing for

10  codification; providing an effective date; and

    declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 5-128.3 of Title 70, unless

17 there is created a duplication in numbering, reads as follows:

18  A. Beginning with the 2026-2027 school year, the board of

19 education of each school district in the state shall spend no less

20 than fifty percent (50%) of its annual budget on instructional

21 expenditures. "Instructional expenditures" means instruction

22 expenditures as defined by the National Center for Education

23 Statistics, a federal entity within the United States Department of

24 Education. If the National Center for Education Statistics ceases

1 to exist, then instructional expenditures shall have the same

2 meaning as provided by an equivalent entity to the National Center

3 for Education Statistics. Instructional expenditures shall not

4 include administrative services as defined in Section 18-124 of this

5 title or for equipment or materials for administrative staff.

6   B. If a school district spends less than fifty percent (50%) of

7 its annual budget on instructional expenditures, the school district

8 shall not provide extracurricular activities for students during the

9 school day for the entirety of the school year that the noncompliant

10 annual budget applies to.

11  C. As used in this section, "annual budget" means a plan of

12 financial operations using revenues contributed from local, state,

13 and federal sources but shall not include revenue received from bond

14 sales, the sale of property or equipment, school fundraisers, or

15 nonprofit organization contributions or grants.

16  SECTION 2. This act shall become effective July 1, 2026.

17  SECTION 3. It being immediately necessary for the preservation

18 of the public peace, health or safety, an emergency is hereby

19 declared to exist, by reason whereof this act shall take effect and

20 be in full force from and after its passage and approval.
