6                            AS INTRODUCED

7   An Act relating to higher education; requiring state

    educational institutions adopt and implement a policy

8   ensuring student grades are evaluated solely on an

    academic basis; requiring policy to prohibit grades

9   based on opinions, beliefs, or conduct; requiring

    submission of verification to the State Regents for

10  Higher Education; directing the State Regents to

    withhold state-appropriated funds for failure to

11  adopt a policy; providing for codification; providing

    an effective date; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 3252 of Title 70, unless there

17 is created a duplication in numbering, reads as follows:

18  A. On or before the 2026-2027 academic year, state educational

19 institutions shall adopt and implement a policy that:

20  1. Requires student grades be evaluated solely on an academic

21 basis which includes, but is not limited to, the student's

22 attendance, demonstrated knowledge or understanding of the content

23 of the course of study, and ability to maintain standards of

24 academic performance established for the course; and

1   2. Prohibits student grades from being evaluated based on the

2 opinion, beliefs, or conduct of the student in matters unrelated to

3 academic situations.

4   B. State educational institutions shall submit verification of

5 compliance with this section to the State Regents for Higher

6 Education. The State Regents shall withhold all state-appropriated

7 funds from any state educational institution which fails to adopt

8 the policy provided for in subsection A of this section until the

9 state educational institution adopts such a policy.

10  SECTION 2. This act shall become effective July 1, 2026.

11  SECTION 3. It being immediately necessary for the preservation

12 of the public peace, health or safety, an emergency is hereby

13 declared to exist, by reason whereof this act shall take effect and

14 be in full force from and after its passage and approval.
