7 AS INTRODUCED
8 An Act relating to smoking; creating the Oklahoma
Clean Indoor Air Act; defining terms; prohibiting
9 smoking in certain places; providing exceptions;
mandating signage; providing for promulgation of
10 rules from the State Department of Health; providing
for noncodification; providing for codification; and
11 providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
15 SECTION 1. NEW LAW A new section of law not to be
16 codified in the Oklahoma Statutes reads as follows:
17 This act shall be known and may be cited as the "Oklahoma Clean
18 Indoor Air Act".
19 SECTION 2. NEW LAW A new section of law to be codified
20 in the Oklahoma Statutes as Section 1-1527.10 of Title 63, unless
21 there is created a duplication in numbering, reads as follows:
22 A. As used in this section:
23 1. "Enclosed area" means a space with a roof and more than two
24 walls;

1 2. "Public place" means any enclosed area to which the public
2 is invited or permitted;
3 3. "Smoking" means cigarettes, cigars, pipes, and electronic
4 smoking devices, including but not limited to vapes; and
5 4. "Workplace" means any indoor area under the control of an
6 employer where employees perform duties.
7 B. Smoking shall be prohibited in all the following places:
8 1. Indoor workplaces, including but not limited to, offices and
9 factories;
10 2. Government buildings;
11 3. Restaurants and bars;
12 4. Public transportation;
13 5. Health care facilities;
14 6. Educational institutions;
15 7. Retail stores and malls; and
16 8. Sports arenas and stadiums.
17 C. Smoking shall be allowed:
18 1. In tobacco shops or cigar bars, with proper ventilation and
19 signage;
20 2. Private residences, unless used for childcare or health care
21 services;
22 3. Designated smoking rooms in hotels, with a limited
23 percentage of rooms; and
24 4. On tribal lands and reservations.

1 D. Establishments shall have clear signage stating "No smoking"
2 at entrances and throughout facilities.
3 E. The State Department of Health shall promulgate rules to
4 enforce the provisions of this act.
5 F. Local governments or municipalities may enact stricter
6 ordinances.
7 SECTION 3. This act shall become effective November 1, 2026.
