7   An Act relating to compound prescription drug

    coverage; amending 36 O.S. 2021, Section 3634.3,

8   which relates to health insurance plan providing

    prescription drug coverage; adding compound

9   prescription drugs; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  36 O.S. 2021, Section 3634.3, is

14 amended to read as follows:

15  Section 3634.3. A. A health insurance plan or policy or health

16 maintenance organization providing prescription drugs as a covered

17 benefit shall provide a pharmacy or group of pharmacies with the

18 right to bid on a periodic basis, but not less than every three (3)

19 years, on any pharmacy contract to provide pharmacy services,

20 including, but not limited to, prescription drugs and compound

21 prescription drugs.

22  B. Nothing in this act shall be interpreted to preclude a

23 health insurance plan or policy or health maintenance organization

24 from establishing an open pharmacy network for the provision of

1 pharmacy services, including, but not limited to, prescription drugs

2 and compound prescription drugs.

3   C. The provisions of this section shall not apply to a health

4 insurance plan or policy or health maintenance organization that

5 maintains an open pharmacy network.

6   SECTION 2. This act shall become effective November 1, 2026.
