6 An Act relating to motor vehicles; amending Section
16, Chapter 366, O.S.L. 2024 (21 O.S. Supp. 2025,
7 Section 20P), which relates to Class D3 offenses;
modifying list of Class D3 offenses; amending 47 O.S.
8 2021, Section 1151, as last amended by Section 109,
Chapter 452, O.S.L. 2024 (47 O.S. Supp. 2025, Section
9 1151), which relates to offenses and penalties
enumerated; classifying the knowing display or
10 manufacture of a fictious license plate as a Class D3
offense; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. AMENDATORY Section 16, Chapter 366, O.S.L.
15 2024 (21 O.S. Supp. 2025, Section 20P), is amended to read as
16 follows:
17 Section 20P. A. Upon the effective date of this act, Class D3
18 shall include the following criminal offenses:
19 1. Violation of the Oklahoma Agricultural Code, as provided for
20 in Section 2-18 of Title 2 of the Oklahoma Statutes;
21 2. Violation of the Oklahoma Farm Animal, Crop, and Research
22 Facilities Protection Act, as provided for in Section 5-105 of Title
23 2 of the Oklahoma Statutes;

1 3. Removing tag from diseased animal, as provided for in
2 Section 6-94 of Title 2 of the Oklahoma Statutes;
3 4. Moving quarantined livestock, in the amount of One Thousand

5 Title 2 of the Oklahoma Statutes;
6 5. Ship or transport of livestock without health certification
7 or permit, as provided for in Section 6-151 of Title 2 of the
8 Oklahoma Statutes;
9 6. Ship or transport of livestock which originated from a
10 quarantined area, as provided for in Section 6-151 of Title 2 of the
11 Oklahoma Statutes;
12 7. Unlawful transport of livestock, as provided for in Section
13 6-155 of Title 2 of the Oklahoma Statutes;
14 8. Slaughter of animals not in compliance with the Oklahoma
15 Meat Inspection Act, as provided for in Section 6-190 of Title 2 of
16 the Oklahoma Statutes;
17 9. Unauthorized labeling of meat products, as provided for in
18 Section 6-191 of Title 2 of the Oklahoma Statutes;
19 10. Selling horsemeat for human consumption, as provided for in

21 11. Bribing or accepting bribe by meat inspector, as provided

19 28. Purchasing or selling burnt copper material or copper wire,
20 second or subsequent offense, as provided for in subsection D of
21 Section 11-94 of Title 2 of the Oklahoma Statutes;
22 29. Interfere with, molest, assault, or impede the progress of
23 forest rangers or firefighters, as provided for in Section 16-6 of
24 Title 2 of the Oklahoma Statutes;

13 214. Impersonating member or veteran of the Armed Forces by
14 wearing medals, as provided for in subsections B and C of Section 6-
15 1 of Title 72 of the Oklahoma Statutes;
16 215. State Auditor and Inspector or any deputy or employee
17 making false report, as provided for in Section 217 of Title 74 of
18 the Oklahoma Statutes;
19 216. Illegal profit by water conservancy district official, as
20 provided for in Section 674 of Title 82 of the Oklahoma Statutes;
21 and
22 217. Provide false information to secure self-insurance permit,
23 as provided for in Section 38 of Title 85A of the Oklahoma Statutes;
24 and

1 218. Knowingly displaying or making a false or fictitious
2 license plate, as provided for in Section 1151 of Title 47 of the
3 Oklahoma Statutes.
4 B. Any person convicted of a Class D3 criminal offense set
5 forth in this section shall be punished by imprisonment in the
6 custody of the Department of Corrections for a term of not more than
7 two (2) years and shall serve at least ten percent (10%) of the
8 sentence imposed before release from custody including release to
9 electronic monitoring pursuant to Section 510.9 of Title 57 of the
10 Oklahoma Statutes.
11 C. 1. Every person who, having been previously convicted of
12 one or two Class C or Class D criminal offenses, commits a Class D3
13 criminal offense shall, upon conviction, be punished by imprisonment
14 in the custody of the Department of Corrections for a term of not
15 less than one (1) year nor more than four (4) years and shall serve
16 at least ten percent (10%) of the sentence imposed before release
17 from custody including release to electronic monitoring pursuant to
18 Section 510.9 of Title 57 of the Oklahoma Statutes.
19 2. Every person who, having been previously convicted of three
20 Class C or Class D criminal offenses, or one or more Class Y, Class
21 A, or Class B criminal offenses, commits a Class D3 criminal offense
22 shall, upon conviction, be punished by imprisonment in the custody
23 of the Department of Corrections for a term of not less than one (1)
24 year nor more than ten (10) years and shall serve at least twenty

1 percent (20%) of the sentence imposed before release from custody
2 including release to electronic monitoring pursuant to Section 510.9
3 of Title 57 of the Oklahoma Statutes.
4 D. Unless specifically exempted pursuant to subsection E of
5 this section, Section 51.1 of Title 21 of the Oklahoma Statutes this
6 title shall not apply to Class D3 criminal offenses.
7 E. The criminal offenses listed in paragraphs 69, 124, 127, and
8 177 of subsection A of this section shall be exempt from the penalty
9 provisions provided for in subsections B and C of this section.
10 Persons convicted of the criminal offenses provided for in
11 paragraphs 69, 124, 127, and 177 of subsection A of this section
12 shall be punished in accordance with the corresponding penalties
13 provided for in the Oklahoma Statutes including Section 51.1 of
14 Title 21 of the Oklahoma Statutes this title.
15 F. All Class D3 criminal offenses shall be punishable by the
16 corresponding fines as provided for in the Oklahoma Statutes.
17 SECTION 2. AMENDATORY 47 O.S. 2021, Section 1151, as
18 last amended by Section 109, Chapter 452, O.S.L. 2024 (47 O.S. Supp.
19 2025, Section 1151), is amended to read as follows:
20 Section 1151. A. It shall be unlawful for any person to commit
21 any of the following acts:
22 1. To lend or to sell to, or knowingly permit the use of by,
23 one not entitled thereto any certificate of title, license plate or
24

1 decal issued to or in the custody of the person so lending or
2 permitting the use thereof;
3 2. To alter or in any manner change a certificate of title,
4 registration certificate, license plate or decal issued under the
5 laws of this or any other state;
6 3. To procure from another state or country, or display upon
7 any vehicle owned by such person within this state, except as
8 otherwise provided in the Oklahoma Vehicle License and Registration
9 Act, any license plate issued by any state or country other than
10 this state, unless there shall be displayed upon such vehicle at all
11 times the current license plate and decal assigned to it by Service
12 Oklahoma or the Corporation Commission or the vehicle shall display
13 evidence that the vehicle is registered as a nonresident vehicle
14 pursuant to rules promulgated by Service Oklahoma, with the
15 concurrence of the Department of Public Safety. A violation of the
16 provisions of this paragraph shall be presumed to have occurred if a
17 person who is the holder of an Oklahoma driver license operates a
18 vehicle owned by such person on the public roads or highways of this
19 state and there is not displayed on the vehicle a current Oklahoma
20 license plate and decal, unless the vehicle is owned by a member of
21 the Armed Forces of the United States assigned to duty in this state
22 in compliance with official military or naval orders or the spouse
23 of such a member of the Armed Forces;

1 4. To drive, operate or move, or for the owner to cause or
2 permit to be driven or moved, upon the roads, streets or highways of
3 this state, any vehicle loaded in excess of its registered laden
4 weight, or which is licensed for a capacity less than the
5 manufacturer's rated capacity as provided for in the Oklahoma
6 Vehicle License and Registration Act;
7 5. To operate a vehicle without proper license plate or decal
8 or on which all taxes due the state have not been paid. No citation
9 may be issued by any state, county or municipal law enforcement
10 officer during the one-month period immediately succeeding the last
11 day of the month during which a vehicle registration should have
12 been renewed and a current license plate decal obtained and
13 displayed on the license plate of the vehicle;
14 6. To buy, sell or dispose of, or possess for sale, use or
15 storage, any secondhand or used vehicle on which the registration or
16 license fee has not been paid, as required by law, and on which
17 vehicle the person neglects, fails or refuses to display at all
18 times the license plate or decal assigned to it;
19 7. To give a fictitious name or fictitious address or make any
20 misstatement of facts in application for certificate of title and
21 registration of a vehicle;
22 8. To purchase a license plate on an assigned certificate of
23 title. This particular paragraph shall be applicable to all persons
24

1 except a bona fide registered dealer in used cars who are holders of
2 a current and valid used car dealer license;
3 9. To operate a vehicle upon the highways of this state after
4 the registration deadline for that vehicle without a proper license
5 plate, as prescribed by the Oklahoma Vehicle License and
6 Registration Act, for the current year;
7 10. For any owner of a vehicle registered on the basis of laden
8 weight to fail or refuse to weigh or reweigh it when requested to do
9 so by any enforcement officer charged with the duty of enforcing
10 this law;
11 11. To operate or possess any vehicle which bears a motor
12 number or serial number other than the original number placed
13 thereon by the factory except a number duly assigned and authorized
14 by the state;
15 12. For any licensed operator to release a license plate, a
16 manufactured home registration receipt, decal or excise tax receipt
17 to any unauthorized person or source including any dealer in new or
18 used motor vehicles. Violation of this paragraph shall constitute
19 sufficient grounds for discharge of a licensed operator by Service
20 Oklahoma;
21 13. To operate any vehicle registered as a commercial vehicle
22 without the lettering requirements of Section 1102 of this title; or
23 14. To operate any vehicle in violation of the provisions of
24 Sections 7-600 through 7-606 of this title while displaying a yearly

1 decal issued to the owner who has filed an affidavit with the
2 appropriate licensed operator in accordance with Section 7-607 of
3 this title.
4 Any person convicted of violating any provision of this
5 subsection, other than paragraph 3 of this subsection, shall be
6 deemed guilty of a misdemeanor and, upon conviction, shall be
7 punished by a fine not to exceed Five Hundred Dollars ($500.00).
8 Any person convicted of violating the provisions of paragraph 3 of
9 this subsection shall be deemed guilty of a misdemeanor and, upon
10 conviction, shall be punished by a fine of not less than One Hundred
11 Dollars ($100.00) and not more than Five Hundred Dollars ($500.00)
12 and shall be required to obtain an Oklahoma license plate.
13 Employees of the Corporation Commission may be authorized by the
14 Corporation Commission to issue citations to motor carriers or
15 operators of commercial motor vehicles, pursuant to the jurisdiction
16 of the Corporation Commission, for a violation of this subsection.
17 If a person convicted of violating the provisions of this subsection
18 was issued a citation by a duly authorized employee of the
19 Corporation Commission, the fine herein levied shall be apportioned
20 as provided in Section 1167 of this title.
21 B. Except as otherwise authorized by law, it shall be unlawful
22 to:
23 1. Lend or sell to, or knowingly permit the use of by, one not
24 entitled thereto any certificate of title issued for a manufactured

1 home, manufactured home registration receipt, manufactured home
2 registration decal or excise tax receipt;
3 2. Alter or in any manner change a certificate of title issued
4 for a manufactured home under the laws of this state or any other
5 state;
6 3. Remove or alter a manufactured home registration receipt,
7 manufactured home registration decal or excise tax receipt attached
8 to a certificate of title or attach such receipts to a certificate
9 of title with the intent to misrepresent the payment of the required
10 excise tax and registration fees;
11 4. Buy, sell or dispose of, or possess for sale, use or storage
12 any used manufactured home on which the registration fees or excise
13 taxes have not been paid as required by law; or
14 5. Purchase identification, manufactured home registration
15 receipt, manufactured home registration decal or excise tax receipt
16 on an assigned certificate of title.
17 Anyone violating the provisions of this subsection, upon
18 conviction, shall be guilty of a felony.
19 C. In the event a new vehicle is not registered within thirty
20 (30) days from date of purchase, the penalty for the failure of the
21 owner of the vehicle to register the vehicle within thirty (30) days
22 shall be One Dollar ($1.00) per day; provided, that in no event
23 shall the penalty exceed One Hundred Dollars ($100.00). No penalty
24 shall be waived by Service Oklahoma or any licensed operator except

1 as provided in subsection C of Section 1127 of this title. Of each
2 dollar penalty collected pursuant to this subsection:
3 1. Twenty-one cents ($0.21) shall be apportioned as provided in
4 Section 1104 of this title;
5 2. Twenty-one cents ($0.21) shall be retained by the licensed
6 operator; and
7 3. Fifty-eight cents ($0.58) shall be deposited in the General
8 Revenue Fund. The penalty for new commercial vehicles shall be
9 equal to the license fee for such vehicles.
10 If a used vehicle is brought into Oklahoma by a resident of this
11 state and is not registered within thirty (30) days, a penalty of
12 One Dollar ($1.00) per day shall be charged from the date of entry
13 to the date of registration; provided, that in no event shall the
14 penalty exceed One Hundred Dollars ($100.00). No penalty shall be
15 waived by Service Oklahoma or any licensed operator except as
16 provided in subsection C of Section 1127 of this title. Of each
17 dollar penalty collected pursuant to this subsection:
18 1. Twenty-one cents ($0.21) shall be apportioned as provided in
19 Section 1104 of this title;
20 2. Twenty-one cents ($0.21) shall be retained by the licensed
21 operator; and
22 3. Fifty-eight cents ($0.58) shall be deposited in the General
23 Revenue Fund. The penalty for used commercial vehicles shall be
24 equal to the license fee for such vehicles.

1 D. 1. Any owner who knowingly makes or causes to be made any
2 false statement of a fact required in this section to be shown in an
3 application for the registration of one or more vehicles shall be
4 deemed guilty of a misdemeanor and, upon conviction, shall be fined
5 not more than One Thousand Dollars ($1,000.00), or shall be
6 imprisoned in the county jail for not more than one (1) year, or by
7 both such fine and imprisonment.
8 2. Any person who knowingly displays, makes, or causes to be
9 made any false or fictitious license plate shall be guilty of a
10 Class D3 felony offense, punishable by imprisonment as provided for
11 in subsections B through F of Section 20P of Title 21 of the
12 Oklahoma Statutes.
13 E. The following self-propelled or motor-driven and operated
14 vehicles shall not be registered under the provisions of the
15 Oklahoma Vehicle License and Registration Act or, except as provided
16 for in Section 11-1116 of this title, be permitted to be operated on
17 the streets or highways of this state:
18 1. Vehicles known and commonly referred to as "minibikes" and
19 other similar trade names; provided, minibikes may be registered and
20 operated in this state by food vendor services upon streets having a
21 speed limit of thirty (30) miles per hour or less;
22 2. Golf carts;
23 3. Go-carts; and

1 4. Other motor vehicles, except motorcycles, which are
2 manufactured principally for use off the streets and highways.
3 Transfers and sales of such vehicles shall be subject to sales
4 tax and not motor vehicle excise taxes.
5 F. Any person violating paragraph 3 or 6 of subsection A of
6 this section, in addition to the penal provisions provided in this
7 section, shall pay as additional penalty a sum equal to the amount
8 of license fees due on such vehicle or registration fees due on a
9 manufactured home known to be in violation and such amount is hereby
10 declared to be a lien upon the vehicle as provided in the Oklahoma
11 Vehicle License and Registration Act. In addition to the penalty
12 provisions provided in this section, any person violating paragraph
13 3 of subsection A of this section shall be deemed guilty of a
14 misdemeanor and shall, upon conviction, be punished by a fine of One
15 Hundred Dollars ($100.00).
16 G. Each violation of any provision of the Oklahoma Vehicle
17 License and Registration Act, for each and every day such violation
18 has occurred, shall constitute a separate offense.
19 H. Anyone violating any of the provisions heretofore enumerated
20 in this section shall be guilty of a misdemeanor and, upon
21 conviction, shall be fined not less than Ten Dollars ($10.00) and
22 not to exceed Three Hundred Dollars ($300.00).
23 I. Any violation of any portion of the Oklahoma Vehicle License
24 and Registration Act where a specific penalty has not been imposed

1 shall constitute a misdemeanor and, upon conviction thereof, the
2 person having violated it shall be fined not less than Ten Dollars
3 ($10.00) and not to exceed Three Hundred Dollars ($300.00).
4 J. Any provision of the Oklahoma Vehicle License and
5 Registration Act providing for proportional registration under
6 reciprocal agreements and the International Registration Plan that
7 relates to the promulgation of rules and regulations shall not be
8 subject to the provisions of this section.
9 SECTION 3. This act shall become effective November 1, 2026.
