7 An Act relating to milk; amending 2 O.S. 2021,
Section 7-414, which relates to the Oklahoma Milk and
8 Milk Products Acts; providing additional acts that
are not prohibited; removing gallon limit for
9 incidental sale of raw milk; and providing an
effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. AMENDATORY 2 O.S. 2021, Section 7-414, is
15 amended to read as follows:
16 Section 7-414. A. The provisions of the Oklahoma Milk and Milk
17 Products Act shall not be construed to:
18 1. Include incidental sales of raw, unpasteurized cow milk,
19 goat milk, sheep milk, donkey milk, and horse milk directly to
20 consumers at:
21 a. the farm where the milk is produced,
22 b. feed stores,
23 c. restaurants,
24 d. at a farmer's market, or

1 e. via delivery from the farm where the milk is produced;
2 2. Preclude Prohibit the advertising of the incidental sale of
3 raw, unpasteurized cow milk, goat milk, sheep milk, donkey milk, and
4 horse milk; and or
5 3. Prohibit any farmer or producer from making cheese using
6 milk or cream produced on the farm of such farmer or producer.
7 B. For purposes of this section, incidental sales of goat milk
8 are those sales where the average monthly number of gallons sold
9 does not exceed one hundred (100).
10 SECTION 2. This act shall become effective November 1, 2026.
