6                            AS INTRODUCED

7   An Act relating to law enforcement officers;

    prohibiting use of face coverings while interacting

8   with the public; providing exceptions; directing law

    enforcement to display certain identification while

9   performing official duties; providing exceptions;

    requiring law enforcement agencies to develop,

10  distribute, and publicly post written policy; stating

    requirements of the policy; providing for

11  codification; and providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 23 of Title 22, unless there is

17 created a duplication in numbering, reads as follows:

18  A. A law enforcement officer shall be prohibited from wearing a

19 face covering that conceals or obscures the identity of the law

20 enforcement officer while interacting with the public in the

21 performance of his or her official duties.

22  B. A face covering shall not include any of the following:

23  1. A medical mask or surgical mask to protect against the

24 transmission of disease or infection or any other mask, helmet, or

1 device including, but not limited to, an air-purifying respirator,

2 full-face mask or half-face mask, or self-contained breathing

3 apparatus necessary to protect against exposure to any toxin, gas,

4 smoke, inclement weather, or any other hazardous or harmful

5 environmental condition;

6   2. A mask, helmet, or device including, but not limited to, a

7 self-contained breathing apparatus necessary for underwater use;

8   3. A motorcycle helmet when worn by a law enforcement officer

9 utilizing a motorcycle or other vehicle that requires a helmet for

10 safe operation while in the performance of his or her official

11 duties; and

12  4. Eyewear necessary to protect a law enforcement officer from

13 the use of retinal weapons including, but not limited to, lasers.

14  C. The provisions of subsection A of this section shall not

15 apply to a law enforcement officer assigned to Special Weapons and

16 Tactics (SWAT) team units while actively performing his or her SWAT

17 responsibilities where a face covering is necessary to protect the

18 face of the law enforcement officer from physical harm, or a law

19 enforcement officer engaged in undercover duties in the regular

20 performance of his or her official duties.

21  D. A law enforcement officer shall visibly display

22 identification that includes the name of the law enforcement agency,

23 the name of the law enforcement officer, and the badge number of the

24 law enforcement officer when performing his or her official duties.

1 The provisions of this subsection shall not apply to a law

2 enforcement officer engaged in undercover duties in the regular

3 performance of his or her official duties.

4   E. Any law enforcement agency operating in the state of

5 Oklahoma shall develop a written policy regarding the identification

6 requirements provided for in subsection D of this section. The law

7 enforcement agency shall distribute the written policy to all law

8 enforcement officers of the agency and publicly post the written

9 policy at the law enforcement agency. The written policy shall

10 include, at a minimum, the following:

11  1. A requirement that all law enforcement officers visibly

12 display identification that includes the name of the law enforcement

13 agency, the name of the law enforcement officer, and the badge

14 number of the law enforcement officer when performing his or her

15 official duties; and

16  2. A narrowly tailored exception for limited undercover

17 assignments.

18  SECTION 2. This act shall become effective November 1, 2026.
