6                            AS INTRODUCED

7   An Act relating to the Supplemental Nutrition

    Assistance Program; directing the Department of Human

8   Services to submit a request to the United States

    Department of Agriculture Food and Nutrition Service;

9   providing information the request shall contain;

    directing the Department to carry out certain tasks;

10  directing the Department to submit annual report;

    providing for codification; and providing an

11  effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 241.5 of Title 56, unless there

17 is created a duplication in numbering, reads as follows:

18  A. The Oklahoma Department of Human Services is hereby directed

19 to submit a request to the United States Department of Agriculture

20 Food and Nutrition Service for a waiver to exclude items sold

21 outside of the State of Oklahoma from being eligible for purchase

22 using Supplemental Nutrition Assistance Program (SNAP) benefits

23 distributed to recipients residing within the State of Oklahoma.

24  B. The waiver request shall include:

1       1. Justification for excluding items sold outside of the State

2 of Oklahoma from SNAP purchases based on economic impacts;

3       2. A proposed implementation plan, including participant

4 education and enforcement mechanisms; and

5       3. Any additional supporting data demonstrating the need for

6 this reform.

7       C. Upon federal approval of the waiver request, the Oklahoma

8 Department of Human Services shall conduct public outreach and

9 education efforts to inform SNAP recipients about the change.

10      D. The Department shall submit an annual report to the

11 Governor, the President Pro Tempore of the Oklahoma State Senate,

12 and the Speaker of the Oklahoma House of Representatives detailing:

13      1. The implementation status of the waiver;

14      2. Any challenges encountered in enforcement and compliance;

15 and

16      3. The economic impacts observed as a result of this policy

17 change.

18      SECTION 2. This act shall become effective November 1, 2026.
