6 AS INTRODUCED
7 An Act relating to motor vehicles; creating the Talyn
Bain Act; requiring the Department of Transportation
8 establish school zones on certain state highways upon
request; requiring local jurisdiction be responsible
9 for certain maintenance and costs; stating when
reduced speeds shall be in effect; requiring
10 Department make certain installations on state
highways; authorizing Department to consult with
11 certain interested parties; setting penalty for
violations; providing for codification; and providing
12 an effective date.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
16 SECTION 1. NEW LAW A new section of law to be codified
17 in the Oklahoma Statutes as Section 11-811 of Title 47, unless there
18 is created a duplication in numbering, reads as follows:
19 A. This act shall be known and may be cited as the "Talyn Bain
20 Act".
21 B. Upon the request of the appropriate local jurisdiction, the
22 Department of Transportation shall establish a maximum forty-five-
23 mile-per-hour school zone on any portion of a state highway that
24 meets any of the following conditions:

1 1. The highway consists of four or more lanes and passes
2 directly adjacent to the property boundary of a public or private
3 school;
4 2. The highway has a posted speed limit of sixty-five (65)
5 miles per hour or greater, lacks a grade-separated off-ramp or
6 frontage road providing access to the school, and passes directly
7 adjacent to the property boundary of a public or private school; and
8 3. The center line of the highway is within one hundred fifty
9 (150) yards from the school property line.
10 C. Upon completion of construction of the school zone, the
11 local jurisdiction shall be responsible for the maintenance and cost
12 of operation of all school zone signage and equipment.
13 D. The reduced speed limit established pursuant to this section
14 shall be enforceable when the beacons are flashing and during:
15 1. School drop-off and pick-up times as indicated by flashing
16 beacons on the school zone signage; and
17 2. Any additional hours designated by the school district and
18 approved by the Department of Transportation.
19 The Department shall erect signage with flashing beacons to
20 clearly indicate the beginning and end of the school zone.
21 E. The Department may consult with the affected school
22 district, municipality, or county commissioners prior to
23 establishing a school zone in an area pursuant to this section.

1 F. Any violation of the speed limit established pursuant to
2 this section shall be enforced in the same manner as other school
3 zone speeding violations established pursuant to Oklahoma law.
4 SECTION 2. This act shall become effective November 1, 2026.
