6                            AS INTRODUCED

7   An Act relating to child care facilities; providing

    legislative finding; directing that licensed child

8   care facilities maintain certain staff-to-child

    ratios; directing the Department of Human Services to

9   promulgate rules; providing for codification; and

    providing an effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW        A new section of law to be codified

16 in the Oklahoma Statutes as Section 405.6 of Title 10, unless there

17 is created a duplication in numbering, reads as follows:

18  A. The Oklahoma Legislature finds that maintaining safe,

19 developmentally appropriate child-to-staff ratios is essential for

20 protecting the welfare of children in licensed child care centers

21 while promoting accessibility and affordability for Oklahoma

22 families.

23  B. Licensed child care centers shall maintain the following

24 minimum staff-to-child ratios:

1   1. For children from birth through eleven (11) months of age,

2 there shall be one (1) staff member for every five (5) children;

3   2. For children from twelve (12) months of age through twenty-

4 three (23) months of age, there shall be one (1) staff member for

5 every six (6) children; and

6   3. For children from twenty-four (24) months of age through

7 forty-seven (47) months of age, there shall be one (1) staff member

8 for every seven (7) children.

9   C. The Department shall promulgate any rules necessary to bring

10 the Oklahoma Administrative Code into conformity with this act.

11  SECTION 2. This act shall become effective November 1, 2026.
