7 An Act relating to postsecondary education; creating
the Sergeant Bobby Swartz Act; amending 70 O.S. 2021,
8 Section 3218.7-1, as amended by Section 2, Chapter
382, O.S.L. 2024 (70 O.S. Supp. 2025, Section 3218.7-
9 1), which relates to waiver of certain higher
education fees and costs for children of persons
10 killed in line of duty; expanding waiver to certain
grandchildren; amending Section 3, Chapter 382,
11 O.S.L. 2024 (70 O.S. Supp. 2025, Section 14-134.1),
which relates to waiver of career and technology
12 education fees for children of persons killed in line
of duty; expanding waiver to grandchildren; providing
13 for noncodification; providing an effective date; and
declaring an emergency.

17 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
18 SECTION 1. NEW LAW A new section of law not to be
19 codified in the Oklahoma Statutes reads as follows:
20 This act shall be known and may be cited as the "Sergeant Bobby
21 Swartz Act".
22 SECTION 2. AMENDATORY 70 O.S. 2021, Section 3218.7-1, as
23 amended by Section 2, Chapter 382, O.S.L. 2024 (70 O.S. Supp. 2025,
24 Section 3218.7-1), is amended to read as follows:

1 Section 3218.7-1. A. Within The Oklahoma State System of
2 Higher Education, no fees nor room and board shall be charged to:
3 1. Children, or grandchildren living at the time of death, of
4 Oklahoma peace officers, as defined by Section 648 of Title 21 of
5 the Oklahoma Statutes, who have given their lives in the line of
6 duty;
7 2. Children, or grandchildren living at the time of death, of
8 Oklahoma firefighters who have given their lives in the line of
9 duty;
10 3. Children, or grandchildren living at the time of death, of
11 commissioned members of the Oklahoma Law Enforcement Retirement
12 System, who have given their lives in the line of duty; and
13 4. Children, or grandchildren living at the time of death, of
14 Oklahoma emergency medical technicians who have given their lives in
15 the line of duty.
16 B. Such waiver of fees and room and board shall be limited to a
17 period of five (5) years.
18 C. Such waiver of fees and room and board shall be a service
19 benefit of a commissioned member of the Oklahoma Law Enforcement
20 Retirement System.
21 D. For purposes of this section:
22 1. "Firefighter" means a volunteer firefighter or a permanent
23 salaried professional member of any fire department within the State
24 of Oklahoma; and

1 2. "Emergency medical technician" means a person volunteering
2 or employed as an emergency medical technician and who is licensed
3 as an emergency medical technician pursuant to Section 1-2505 of
4 Title 63 of the Oklahoma Statutes.
5 SECTION 3. AMENDATORY Section 3, Chapter 382, O.S.L.
6 2024 (70 O.S. Supp. 2025, Section 14-134.1), is amended to read as
7 follows:
8 Section 14-134.1. A. Within the system of career technology
9 districts, no fees shall be charged to:
10 1. Children, or grandchildren living at the time of death, of
11 Oklahoma peace officers, as defined by Section 648 of Title 21 of
12 the Oklahoma Statutes, who have given their lives in the line of
13 duty;
14 2. Children, or grandchildren living at the time of death, of
15 Oklahoma firefighters who have given their lives in the line of
16 duty;
17 3. Children, or grandchildren living at the time of death, of
18 commissioned members of the Oklahoma Law Enforcement Retirement
19 System, who have given their lives in the line of duty; and
20 4. Children, or grandchildren living at the time of death, of
21 Oklahoma emergency medical technicians who have given their lives in
22 the line of duty.
23 B. Such waiver of fees shall be limited to a period of five (5)
24 years.

1 C. Such waiver of fees shall be a service benefit of a
2 commissioned member of the Oklahoma Law Enforcement Retirement
3 System.
4 D. For purposes of this section:

12 SECTION 4. This act shall become effective July 1, 2026.
13 SECTION 5. It being immediately necessary for the preservation
14 of the public peace, health or safety, an emergency is hereby
15 declared to exist, by reason whereof this act shall take effect and
16 be in full force from and after its passage and approval.
