6                            AS INTRODUCED

7   An Act relating to professions and occupations;

    modifying the Oklahoma Administrative Code; modifying

8   requirements for funeral establishment vendor payment

    rules; providing for codification; and providing an

9   effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      NEW LAW  A new section of law to be codified

14 in the Oklahoma Statutes as Section 397 of Title 59, unless there is

15 created a duplication in numbering, reads as follows:

16  This section shall modify the Oklahoma Administrative Code

17 Section 235:10-11-1 by the following provisions:

18  1. Penalties for vendor payments may only be imposed after a

19 formal court judgment;

20  2. Penalties may only be imposed on funeral establishments and

21 may not be imposed against the Funeral Director in Charge;

22  3. These rules are only applicable to active funeral

23 establishments;

1   4. All funeral establishments must be in compliance with

2 federal bankruptcy laws;

3   5. All cash payments made in advance must meet the requirements

4 of consumer fund receipts.

5   SECTION 2. This act shall become effective November 1, 2025.
