6                             AS INTRODUCED

7   An Act relating to railroads; defining terms;

    limiting the length of certain trains; providing for

8   codification; and declaring an emergency.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.       NEW LAW  A new section of law to be codified

13 in the Oklahoma Statutes as Section 105 of Title 66, unless there is

14 created a duplication in numbering, reads as follows:

15  A. As used in this section:

16  1. "Branch line" means a secondary line that branches off from

17 a main line; and

18  2. "Main line" means a Class 1 railroad documented in current

19 timetables filed as required pursuant to 49 C.F.R. 217.7 with the

20 Federal Railroad Administration. A main line is used for regular

21 scheduled freight or passenger service.

22  B. Railroads are prohibited from operating any branch line or

23 main line train that exceeds a length of eight thousand five hundred

24 (8,500) feet.

1   SECTION 2. It being immediately necessary for the preservation

2 of the public peace, health or safety, an emergency is hereby

3 declared to exist, by reason whereof this act shall take effect and

4 be in full force from and after its passage and approval.
