6                            AS INTRODUCED

7   An Act relating to public health and safety; defining

    term; prohibiting the manufacture, sell, hold or

8   offer for sale, or distribution of cultivated meat;

    providing punishment for violation; providing for

9   revocation of certain licenses for violation;

    providing the Oklahoma State Department of Health

10  certain rulemaking authority; providing exemptions;

    providing for codification; and providing an

11  effective date.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 1-1150 of Title 63, unless there

17 is created a duplication in numbering, reads as follows:

18  A. For the purposes of this section, the term "cultivated meat"

19 means a meat or meat product that was produced from cultured animal

20 tissue produced from in vitro animal cell cultures outside of the

21 animal from which the cells were derived.

22  B. 1. It shall be unlawful for any person to manufacture,

23 sell, hold or offer for sale, or distribute any cultivated meat

24 product in this state.

1   2. Any person who violates the provisions of this subsection

2 shall, upon conviction, be guilty of a misdemeanor.

3   C. 1. A seller of food under Sections 1-1118, 1-1118.1, and 1-

4 1119 of Title 63 of the Oklahoma Statutes that sells or distributes

5 cultivated meat products in violation of subsection B of this

6 section shall be subject to all enforcement measures as provided by

7 rule of the Oklahoma State Department of Health.

8   2. The license of a seller of food may be suspended or revoked,

9 as provided by rule of the Oklahoma State Department of Health upon

10 the conviction of an owner or an employee of the licensed seller of

11 food for a violation of subsection B of this section.

12  D. The Oklahoma State Department of Health may adopt rules as

13 necessary to implement this section.

14  E. Nothing in this section shall be construed as preventing any

15 federal, state, or local governmental entity or institution of

16 higher education, or a person that is partnered with a governmental

17 entity or institution of higher education as evidenced by a formal

18 agreement, from conducting research in this state regarding the

19 production of cultivated meat products.

20  SECTION 2. This act shall become effective November 1, 2025.
