6                               AS INTRODUCED

7   An Act relating to crimes and punishments; amending

    21 O.S. 2021, Section 540, which relates to

8   obstruction of justice; clarifying scope of certain

    prohibited act; providing an exception; and providing

9   an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      AMENDATORY  21 O.S. 2021, Section 540, is

14 amended to read as follows:

15  Section 540. A. Any person who willfully delays or obstructs

16 any public officer in the discharge or attempt to discharge any duty

17 of his or her office, is, upon conviction, guilty of a misdemeanor.

18  B. Nothing in this section shall preclude a person from

19 recording the activity of law enforcement in a public area, as long

20 as the recording activity does not delay or obstruct the law

21 enforcement agent in his or her duties.

22  C. Inquiries by a person being stopped, detained, or arrested

23 by a law enforcement officer or by a bystander who is observing

24 another person being stopped, detained, or arrested by a law

1 enforcement officer, shall not be deemed obstruction of justice,

2 unless such inquiries by the person or bystander are purposefully

3 intended to hinder, delay, or obstruct the authority of the law

4 enforcement officer in discharging his or her duties.

5   SECTION 2. This act shall become effective November 1, 2025.
