7 An Act relating to education; amending 70 O.S. 2021,
Section 1-124, which relates to per-pupil expenditure
8 definition; expanding definition; providing an
effective date; and declaring an emergency.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1-124, is
14 amended to read as follows:
15 Section 1-124. A. Unless otherwise specifically defined, "per-
16 pupil expenditure" shall mean the aggregate current expenditures of
17 school districts, from all funding sources including federal funds,
18 state funds and local funds, plus the direct support aggregate
19 current expenditures of the state for the day-to-day operations of
20 schools and school districts from all funding sources including
21 federal funds, divided by the aggregate student membership number
22 for the same fiscal year for which the expenditures are determined.
23 The aggregate student membership number shall be the count of
24 students enrolled on October 1 or the school day closest to October

1 1 to whom school districts in the state provide a public education.
2 The aggregate current expenditures shall include without limitation
3 the following categories of expenditures:
4 1. Instruction provided by school district instructional staff;
5 2. Instruction provided through career and technology education
6 programs in comprehensive schools;
7 3. Instruction provided through concurrent classes that satisfy
8 graduation requirements;
9 4. Support services for students;
10 3. 5. Support services for instructional staff;
11 4. 6. Support services for general administration;
12 5. 7. Support services for school administration;
13 6. 8. Support services for business;
14 7. 9. Operation and maintenance of plant services;
15 8. 10. Student transportation services;
16 9. 11. Child nutrition services; and
17 10. 12. Enterprise services.
18 B. Aggregate current expenditures shall not include
19 expenditures for adult and community education, facilities
20 acquisition and construction services, debt services, property, and
21 other expenditures not related to the day-to-day operations.
22 C. The provisions of subsection A of this section shall apply
23 when related to the expenditure of public funds by educational and
24 governmental entities. When reporting or publishing the per-pupil

1 expenditure for any purpose, the State Department of Education shall
2 also report or publish each category of expenditure as listed in
3 subsection A of this section as well as the aggregate expenditure.
4 SECTION 2. This act shall become effective July 1, 2025.
5 SECTION 3. It being immediately necessary for the preservation
6 of the public peace, health or safety, an emergency is hereby
7 declared to exist, by reason whereof this act shall take effect and
8 be in full force from and after its passage and approval.
