6                             AS INTRODUCED

7   An Act relating to property; providing setback

    requirements for solar energy facilities; providing

8   for codification and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

13  SECTION 1.      NEW LAW   A new section of law to be codified

14 in the Oklahoma Statutes as Section 1501 of Title 60, unless there

15 is created a duplication in numbering, reads as follows:

16  Solar energy facilities, excluding residential solar energy

17 panels, shall have the following setback requirements:

18  1. Shall not be located within five hundred (500) feet of an

19 occupied structure or occupied residence unless waived in writing by

20 the owner of the structure or residence;

21  2. Shall not be located within one hundred (100) feet of any

22 outer boundary of the facility property;

23  3. Shall not be located within one hundred (100) feet from any

24 public road right-of-way.

1   SECTION 2. This act shall become effective November 1, 2025.
