8   An Act relating to public health and safety;

    providing definitions; requiring surgical smoke

9   policies for health care employers; providing for

    codification; and providing an effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

14  SECTION 1.      NEW LAW    A new section of law to be codified

15 in the Oklahoma Statutes as Section 1-706.6 of Title 63, unless

16 there is created a duplication in numbering, reads as follows:

17  A. As used in this section:

18  1. "Health care employer" means a hospital as defined in

19 Section 1-701 of Title 63 of the Oklahoma Statutes, or an ambulatory

20 surgical facility or outpatient surgical center;

21  2. "Smoke evacuation system" means equipment that effectively

22 captures and filters surgical smoke at the site of origin before the

23 smoke makes contact with the eyes or the respiratory tract of

24 occupants in the room; and

1   3. "Surgical smoke" means the gaseous by-product produced by

2 energy-generating devices including surgical plume, smoke plume,

3 bio-aerosols, laser-generated airborne contaminants, or long-

4 damaging dust.

5   B. A health care employer shall adopt and implement policies to

6 prevent exposure to surgical smoke by requiring the use of a smoke

7 evacuation system during any surgical procedure that is likely to

8 generate surgical smoke.

9   SECTION 2. This act shall become effective November 1, 2025.
