6                            AS INTRODUCED

7   An Act relating to marriage and family; enacting 43

    O.S. Section 115.1, which relates to child support;

8   establishing penalties for failure to pay child

    support; and providing an effective date.

11 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

12  SECTION 1.      NEW LAW  A new section of law to be codified

13 in the Oklahoma Statutes as Section 115.1 of Title 43, unless there

14 is created a duplication in numbering, reads as follows:

15  Section 115.1. A. Civil actions for failure to pay child

16 support may be brought by the custodial parent under the following

17 conditions:

18  1. The noncustodial parent fails to pay court ordered child

19 support for a consecutive three-month period.

20  2. The noncustodial parent purposely evades the court by

21 failing to accurately report income, and the custodial parent has

22 evidence of failure to disclose.

1   B. If courts find the noncustodial parent in violation of

2 Subsection A of this section, the court may order property and

3 assets to be seized in addition to requiring backpay.

4   SECTION 2. This act shall become effective November 1, 2025.
