7   An Act relating to state government; creating the

    State Parks Emergency Maintenance Act; requiring the

8   creation of an Eight-Year State Parks Emergency

    Maintenance Plan; requiring annual reporting; listing

9   specific information to be reported; establishing

    format and delivery requirements; creating the State

10  Parks Emergency Maintenance Revolving Fund;

    identifying funding source; limiting expenditures;

11  providing budgeting and expenditure procedures;

    providing for codification; providing an effective

12  date; and declaring an emergency.

15 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

16  SECTION 1.      NEW LAW     A new section of law not to be

17 codified in the Oklahoma Statutes reads as follows:

18  This act shall be known and may be cited as the "State Parks

19 Emergency Maintenance Act".

20  SECTION 2.      NEW LAW     A new section of law to be codified

21 in the Oklahoma Statutes as Section 2254.3A of Title 74, unless

22 there is created a duplication in numbering, reads as follows:

23  Beginning December 31, 2025, and no later than December 31 each

24 year thereafter, the Oklahoma Tourism and Recreation Department

1 shall submit in written or electronic format to the Governor, the

2 Speaker of the Oklahoma House of Representatives, the President Pro

3 Tempore of the Oklahoma State Senate, the Appropriations and Budget

4 Chair of the Oklahoma House of Representatives, and the

5 Appropriations Chair of the Oklahoma State Senate an annual report

6 on the maintenance, infrastructure, and construction needs of the

7 State Parks System overseen by the Oklahoma Tourism and Recreation

8 Department. The annual report shall be known and may be cited as

9 the "Eight-Year State Parks Emergency Maintenance Plan", and shall

10 include:

11  1. Maintenance, infrastructure, and construction projects

12 listed in order of priority and critical need;

13  2. Cost estimates for each specific project listed in

14 paragraph 1 of this subsection;

15  3. Completion timeline for each specific project listed in

16 paragraph 1 of this subsection; and

17  4. A summary of the status of projects previously funded and

18 currently being funded pursuant to the provisions of the State Parks

19 Emergency Maintenance Act.

20  SECTION 3.      NEW LAW    A new section of law to be codified

21 in the Oklahoma Statutes as Section 2254.3B of Title 74, unless

22 there is created a duplication in numbering, reads as follows:

23  There is hereby created in the State Treasury a revolving fund

24 for the Oklahoma Tourism and Recreation Department to be designated

1 the "State Parks Emergency Maintenance Revolving Fund". The fund

2 shall be a continuing fund, not subject to fiscal year limitations,

3 and shall consist of all monies received by the Oklahoma Tourism and

4 Recreation Department eligible under law and directed for deposit to

5 such fund. All monies accruing to the credit of said fund are

6 hereby appropriated and may be budgeted and expended by the Oklahoma

7 Tourism and Recreation Department in amounts as authorized by the

8 Oklahoma Legislature, for the purpose of implementing the

9 Department's Eight-Year State Parks Emergency Maintenance Plan, as

10 described in Section 2 of this act; provided, that in no event shall

11 an amount greater than twenty percent (20%) of the annual amount

12 accruing to the fund shall be used for funding operational expenses

13 of the Department in any given state fiscal year. Expenditures from

14 said fund shall be made upon warrants issued by the State Treasurer

15 against claims filed as prescribed by law with the Director of the

16 Office of Management and Enterprise Services for approval and

17 payment.

18  SECTION 4. This act shall become effective July 1, 2025.

19  SECTION 5. It being immediately necessary for the preservation

20 of the public peace, health or safety, an emergency is hereby

21 declared to exist, by reason whereof this act shall take effect and

22 be in full force from and after its passage and approval.
