7   An Act relating to school athletics; declaring right

    of schools to broadcast certain games; prohibiting

8   certain Oklahoma Secondary School Activities

    Association contractual agreements from preventing

9   school broadcasts; stating applicability of act;

    defining terms; providing for codification; providing

10  an effective date; and declaring an emergency.

14 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

15  SECTION 1.      NEW LAW  A new section of law to be codified

16 in the Oklahoma Statutes as Section 27-200 of Title 70, unless there

17 is created a duplication in numbering, reads as follows:

18  A. Schools shall have the right to broadcast all high school

19 athletic activities in this state in which the school's athletic

20 team is participating.

21  B. If the Oklahoma Secondary School Activities Association

22 enters into an exclusive broadcast agreement for an athletic

23 activity, such agreement shall not prohibit a local broadcaster or

24

1 school from broadcasting a school's athletic activity in which the

2 school's athletic team is participating.

3   C. The provisions of this section shall apply to contracts

4 involving the right to broadcast that are entered into or renewed on

5 or after the effective date of this act.

6   D. For purposes of this section:

7   1. "Athletic activity" means any high school athletic pre-

8 season, regular season, or playoff game;

9   2. "Broadcast" means the live or recorded audio or video

10 transmission over airwaves, streaming, or other transmission of an

11 athletic activity, play-by-play, or other account of such activity

12 via radio, television, Internet, or other technologies;

13  3. "Exclusive broadcast agreement" means an agreement entered

14 into between the Oklahoma Secondary School Activities Association

15 and an organization to broadcast the Oklahoma Secondary School

16 Activities Association's athletic activities under which such

17 organization retains sole rights to broadcast such activities or

18 first right to broadcast such activities;

19  4. "Local broadcaster" means an organization, located in

20 Oklahoma, that provides local broadcast services for any activity of

21 a local school. Local broadcaster includes school-sponsored

22 organizations that produce student-organized broadcasts such as

23 educational courses or programs offered by the school; and

1   5. "Organization" means an individual, public or private

2 corporation, partnership, limited liability company, association,

3 joint venture, or any other legal or commercial entity.

4   SECTION 2. This act shall become effective July 1, 2025.

5   SECTION 3. It being immediately necessary for the preservation

6 of the public peace, health or safety, an emergency is hereby

7 declared to exist, by reason whereof this act shall take effect and

8 be in full force from and after its passage and approval.
