7 An Act relating to children; directing the Department
of Human Services to work with the State Fire Marshal
8 to develop certain guidelines; declaring certain
child care homes shall not be denied license if
9 complies with the IRC; prohibiting stricter
requirements than those outlined in the IRC;
10 providing for codification; and providing an
effective date.

13 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
14 SECTION 1. NEW LAW A new section of law to be codified
15 in the Oklahoma Statutes as Section 404.4 of Title 10, unless there
16 is created a duplication in numbering, reads as follows:
17 The Department of Human Services shall work with the State Fire
18 Marshal to develop guidelines that allow family child care homes and
19 large child care homes to operate under the fire protection
20 requirements of the International Residential Code (IRC). Family
21 child care homes and large child care homes shall not be denied a
22 license to operate should they comply with the requirements of the
23 IRC. No agency, municipality, county, or other political
24 subdivision of this state shall place stricter fire requirements

1 than those outlined in the IRC on family child care homes and large
2 child care homes.
3 SECTION 2. This act shall become effective November 1, 2025.
