6 AS INTRODUCED
7 An Act relating to sepsis protocols; defining term;
directing hospitals to establish sepsis protocols;
8 implementing guidelines for sepsis protocols;
mandating staff training; providing clinical criteria
9 for Medicaid and Medicare services; providing for
codification; and providing an effective date.

12 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
13 SECTION 1. NEW LAW A new section of law to be codified
14 in the Oklahoma Statutes as Section 1-724.1 of Title 63, unless
15 there is created a duplication in numbering, reads as follows:
16 A. "Sepsis" means a proven or suspected infection accompanied
17 by a systemic inflammatory response.
18 B. A hospital shall establish, implement, and periodically
19 update evidence-based protocols for the early identification and
20 treatment of patients with sepsis and septic shock.
21 C. The sepsis protocols shall address, at a minimum:
22 1. Screening patients for, and early recognition in patients
23 of, health-care-acquired and community-acquired sepsis and septic
24 shock;

1 2. Identification of patients for whom treatment, using the
2 sepsis protocols, is appropriate, and for whom treatment would be
3 inappropriate based on patient-specific clinical or bioethical
4 considerations, and documentation of these patient identification
5 activities;
6 3. Treatment guidelines;
7 4. Components that are population-specific as clinically
8 indicated in accordance with evidence-based best practices, such as
9 perinatal, neonatal, pediatric, and adult variations that may exist
10 in the identification and treatment of sepsis, with corresponding
11 development and use of clinical staff training materials and
12 practice tools that distinctly identify these population-specific
13 variations; and
14 5. Training of clinical staff in the sepsis protocols and
15 providing updated training upon substantive revisions thereof.
16 D. A hospital shall ensure that appropriate clinical staff
17 receive training in the sepsis protocols.
18 SECTION 2. NEW LAW A new section of law to be codified
19 in the Oklahoma Statutes as Section 1-724.2 of Title 63, unless
20 there is created a duplication in numbering, reads as follows:
21 For purposes of the early identification and treatment of
22 sepsis, and for consistency with the ICD-10-CM coding classification
23 system utilized by the federal Centers for Medicare and Medicaid
24 Services, any third-party payor or managed care organization with

1 which the Oklahoma Health Care Authority contracts for the delivery
2 of Medicaid services, and any health benefit plan as defined
3 pursuant to Section 6060.4 of Title 36 of the Oklahoma Statutes,
4 shall use and apply clinical criteria for sepsis that requires no
5 more than:
6 1. A provider's diagnosis of sepsis and that a suspected or
7 confirmed source of infection is present; and
8 2. The presence of two or more symptoms indicating inflammatory
9 response syndrome which may include elevated values of the patient's
10 body temperature, heart rate, white blood count, or respiratory
11 rate.
12 SECTION 3. This act shall become effective November 1, 2025.
